Hi everyone,

Really enjoying reading through all the helpful answers. :)

I would love your answer on a quick question.

Some info:

I've had my green card for 9 years, and I'm about to fill out my N-400.

I've been married to a US citizen for 12 years.

Questions:

Which option should I file under Part 2 (Eligibility)? I qualify for both options...

Is one of the options faster?

A. I have been a lawful permanent resident for at least 5 years.

B. I have been a lawful permanent resident for at least 3 years, and I have been married to the same US Citizen for 3 years.

I'd love to hear about your experiences. :)

Option B lets you apply for US citizenship after only being a LPR and married for only three years but requires a lot of proof about your marriage history. Since you already have been a LPR for at least five years, you no longer have need of that marriage privilege so no need for all that extra work.

Would be kind of like going to a court of law just asking for proof where you at 10:00 PM September 12, 2010 and you bring proof of where you were everyday of your life. They don't want to hear about all that latter stuff and neither will the USCIS about your proof of marriage.

Agreed with NickD, apply on the basis of five years as a permanent resident and enjoy less paperwork headache. :thumbs:

Oct 15, 2010: Citizenship Interview - Passed!
Nov 15, 2010: Oath Ceremony in Fresno, CA
Nov 24, 2010: Did SSN and Applied for Passport
Dec 6, 2010: Passport Arrives
Dec 7, 2010: Sent for Indian Passport Surrender Certificate
Dec 27, 2010: Surrender Certificate Arrives
Jan 3, 2011: Sent for Overseas Citizenship of India Card
March 1, 2011: Received OCI card!

Divorce

Feb 2015:​ Found out he was cheating (prostitutes / escorts)

​May 2015: Divorce Final
