60 days after RFE

Timeline

The USCIS processing dates were updated on August 3, 2006 for all centers.

Processing dates for I-129F petitions are as follows:

California: March 6, 2006

Texas: March 6, 2006

Vermont: April 3, 2006

The service centers ask that you contact them if:

If you filed your case 30 days or more before the date shown under the heading "Processing Cases with Receipt Date of" and you have not received a request for evidence, a decision, or another notice in the last thirty days, please call our National Customer Service Center at 1-800-375-5283

If you received a request for evidence and you responded more than 60 days ago and have not received a DECISION, please call our National Customer Service Center at 1-800-375-5283.

So most everyone is still under the 60 days requested by USCIS.

The only cases that have had preliminary processing are the recalled petitions. All other petitions are adjudicated after complying with IMBRA and subject to second RFE's.

We are quickly destroying any type of correspondence with the USCIS with the repeated phone calls for a process thats running it's course. California doesn't take e-mails anymore and now the USCIS is discouraging callers by stating to call back if your 6 months out from your NOA1. I realize I'm fighting a losing battle here and everyone will keep calling anyway. But I bet you they don't have the answer your looking for. I mean, what do we really want them to say. They are customer service reps who really don't have the answers we're looking for. And the fact of the matter is we're all in line. There are 10s of thousands of petieions all across the country, plus a backlog being cleared away. And it didn't start until the RFE's were received for IMBRA.

Have faith VJers!! the NOA2's are coming!! slowly! but there coming. Of course those of you who filed in March, April, and May have waited the longest, the USCIS didn't figure out how to apply the new law into the petitions until June, everyone had to wait for that. I waited for the new petition to even file, so I've been waiting with you. We have all filed at a tough time for immigration. Things are changing, laws are being made, and we're caught in the middle of it. Some worse than others. USCIS is working on the petitions and there still updating there processing times. Good Luck to everyone!!! and I bet your NOA2's come before the 60 days, if not call for answers!!

I know I'm gonna be hated for this post, but I'm just trying to put some light at the end of the tunnel. Give it 60 days and you should have your answers.

06/30/06- sent I-129F petition to VSC.

07/11/06- NOA1 (received in mail)

07/19/06- RFE received in mail, IMBRA

07/28/06- e-mail, IMBRA RFE received at VSC

09/11/06- called VSC, told I'm with an adjudicating officer

09/25/06- called VSC, told to file expedited service, outside 60 days of RFE received date

09/26/06- sent expedited service request to VSC via fax and snail mail

09/26/06- Senators and Congressman making inquiries into my petition

09/29/06- expedited service request approved by VSC director

10/04/06- e-mail NOA2 approved!!!!!!

10/05/06- NVC received

10/06/06- NVC forwarded to Poland Embassy

10/16/06- Packet #3 received

10/17/06- Packet #3 sent to US Embassy Warsaw

10/30/06- Packet #4 received

10/30/06- Interview scheduled for November 22nd!!!

11/30/06- Visa in hand, via DHL!!!!

12/05/06- Ania and I arrive together in the USA

02/11/07- Ania applied for Social Security Card

02/17/07- Ania and I were MARRIED!!!!!!

07/24/07- Social Security Card in hand- after some minor issues and a little procrastination :)

10/14/07- I-485, I-765, and permission to travel mailed to USCIS

10/17/07- Received NOA1

12/17/07- I-485 shipped to California Service Center for faster service

12/17/07- I-765 approved new card should be mailed within 30 days, Advanced parole approved

02/28/08- AOS APPROVED!!!! PERMANENT RESIDENT CARD RECEIVED!!!!! (card received couple weeks after approval)

05/2005 - Met on line

06/20/05 - first serious e-mails

01/15/06 - traveled to China to meet Yonghua and family

02/24/06 - I-129 F sent (K1 visa) Laguna

03/01/06 - I-129 F delivered at USCIS

03/06/06 - I-129F received date (check processed)

03/07/06 - NOA1 issued

03/10/06 - NOA1 received

06/23/06 - Notice date on RFE

06/28/06 - RFE for IMBRA received and mailed back to CSC

06/30/06 - RFE received at CSC

09/08/06 - NOA2 notice date

09/12/06 - received NOA2 in mail

10/02/06 - received and case number issued at NVC

10/19/06 - Case sent to Consulate in Guangzhou

- update -

05/22/07 - Visa approved

06/15/07 - SO arrives at LAX

07/07/07 - Married

07/24/07 - AOS filed

Well, they haven't been able to adjudicate since then. Everything was put on hold. They just recently have been able to start adjudicating. Now there back to adjudicating at there normal slow pace with a backlog to deal with.

06/30/06- sent I-129F petition to VSC.

07/11/06- NOA1 (received in mail)

07/19/06- RFE received in mail, IMBRA

07/28/06- e-mail, IMBRA RFE received at VSC

09/11/06- called VSC, told I'm with an adjudicating officer

09/25/06- called VSC, told to file expedited service, outside 60 days of RFE received date

09/26/06- sent expedited service request to VSC via fax and snail mail

09/26/06- Senators and Congressman making inquiries into my petition

09/29/06- expedited service request approved by VSC director

10/04/06- e-mail NOA2 approved!!!!!!

10/05/06- NVC received

10/06/06- NVC forwarded to Poland Embassy

10/16/06- Packet #3 received

10/17/06- Packet #3 sent to US Embassy Warsaw

10/30/06- Packet #4 received

California has been March 6th for well over a month now.

It will be for quite a while...If we use Andys logic, CSC can have all the windows they want.

I will not be told that I cannot check on my case. As I recall, my letter said 80-110 days. I submitted my file AFTER IMBRA existed. Yes, they didnt implement it as they should. I in turn got requested for more information (AKA IMBRA RFE). I returned that and its been over 30 days (not counting the 5 additional for them to acknowledge it). My timeline is over 140 days. Yet I see approvals of 15 days, 41 days, and many other timeframes. USCIS knows theres an issue. Instead of trying to make it fair, they are trying to mask the issue by answers such as 'wait'. Sorry, its not acceptable.

I have a right to ask questions. If CSC would give answers instead of keeping some dark mystery, then the same person would not have to call 20x or have senators or congressmans offices involved. REALITY CHECK, IF YOU GIVE THE INFORMATION, THEY DONT HAVE TO CALL SO MUCH...WOW, THAT MEANS LESS CALLS! I submitted what was asked, when it was asked, to where I was supposed to. I have a right to updates instead of stall tactics.

I also dont need someone that this does not effect telling me I am not entitled to it.

Where is this information coming from? What did they do for 3 months??? Sit on their thumbs? Dont sit there and justify them. If they processed what they had (as the preprocessing email said that many of us recieved), they would have only had to process the IMBRA form. That would have been quick.

Anyways the LAST OFFICIAL CONTACT I got from the CSC was that the initial processing was done and that it wouldnt take as long as originally stated (yes, that was after returning the IMBRA). We are outside that timeframe....

6/23/06 - They they sent the IMBRA RFE

7/03/06 - The emailed that the IMBRA RFE went out on 6/23/06

7/03/06 - I received IMBRA RFE

7/05/06 - Touched

7/06/06 - Delivery Confirmation from the Post Office RFE recieved

7/11/06 - Email notification from CSC that IMBRA RFE Recieved

7/12/06 - Touched (but was to respond to an email that only said 'request recieved and will be processed within 30 days. argh)

7/13/06 - Touched

NOA2 September 11!!!

10/18/06 - Received at Embassy

12/23/06 - Recieved package with interview/medical schedule

01/08/06 - CFO interview/(pre-departure class) Complete

1/11/07 & 1/12/07 Medical complete

02/05/07 - Interview!!!

2/7/07 (2/8/07 manila) - Informed we are approved...3 days after interview.

2/12/07 Visa Received

2/16/07 Baby arrives in US!!!!!

4/14/07 Wedding

4/21/07 Filed AOS

uhh! I'd like to know first, who is saying your not entitled to be upset or to want answers. Good luck getting those answers. USCIS has covered there bases on this one. Second, I have been effected by this. I wanted to file in April but had to wait for the new petition to be created!!! plus!! I have issues that are IMBRA related!! so don't tell me I'm not effected!!

What have they done for 3 months???? I-129F's are not the only immigration petitions that are processed at the service centers.

As far as you LAST OFFICIAL CONTACT IS CONCERNED, did you read the memorandum

When the RFE is returned, the adjudicator should review it to determine whether the petitioner has responded to all of the questions and submitted the requested additional information, including criminal history information, and an original signature in the attestation block. If the Form I-129F is not signed or is not complete (because all of the questions are not answered or because requested documentation is still missing) or if the petitioner fails to provide the requested information in response to the RFE, the adjudicator should deny the petition.

Adjudicator should review the Form I-129F for completeness, noting supporting documentation that is not present. At this stage, a second RFE may be required for missing items such as date of last meeting or the Form G-325A, Biographic Information.

Don't you think this would leave one to believe that preliminary processing in fact was not completed??? you figure it out for yourself.

and correction, it wasn't April that I wanted to file, it was May, sorry!
