Good afternoon,

There are limitations with the posted processing times that we are working to address. We currently post updated processing times in the middle of each month; however, because it takes time for us to validate the data, the processing times refer to what was in effect (generally) 45 days earlier. For example, the most recent processing times were posted to the USCIS website on March 14, but they are accurate as of Jan. 31. So, as of Jan. 31, the processing time for I-129Fs was 5 months – this would bring us back to August 31. Unfortunately, for your case, this means that your petition is still within normal processing times.

This is so frustrating, I feel like I'm doing everything I possibly can and it's getting me nowhere....

That's about the most twisted logistical mess I could possibly conceive of. Where did he get that 45 days number? No one has ever mentioned that before. His calculation reeks of deceit and it sounds like he changes it every time he gets a request from someone. We know darn well that most people who submitted on August 31 were not processed the end of January. Is Drew for real? How does he sleep at night? Hang in there kikip!

So ya I have tried to call the Vermont Service Center a couple of times this morning. It says call back after 8:00am. ITS 8:50AM IN VERMONT RIGHT NOW!

I just talked to them and of course they just gave me the run around and would not put in a service request. I asked why did the lady promise me that if I called in 1 month I would get one? Did she lie to me? He just said those dates are estimated and I said well she shouldnt make empty pormises. I told them I know some people are getting service requests in after September 11th dates. He just said he cant look at what other people are doing and cannot put in a service request. I ended up hanging up on the guy though before I got too angry and started yelling at him. I dont want them to throw my application in the trash.

I will. I just need to calm down for a little bit. I am trying to be very polite on the phone at first but I just get fired up. Which is really out of character for me because I am probably one of the most easy going passive people you will meet in real life. This situation just makes my blood boil so to put on a nice face again I need to wait.

I just talked to my senators office he said he would call them but I have to call him back on Friday morning for results. I also emailed my congressmans office and the guy there is really good about getting back to me. (He is a friend of a friend so he said he would pay extra attention to my case).

I'm waiting to hear back from my senator who emailed Vermont again yesterday since they previously emailed to say I couldn't do anything til I was 30 days past 5 months. The original email Vermont sent said we would get expedition at 30 days past five months. We'll see if that's true... I find it odd that no one on VJ past Sept 22 has been approved, yet 26 people in later months have their NOA2's. Very frustrating...

Today it's been 31 calendar days from my 5 month mark. I waited to call today just to make sure they didn't say anything about it not being at least 30 days past the 5 month mark. I called customer service and was told I had to wait until 30 days from my last call. They wouldn't transfer me to a Tier 2 and said they couldn't even tell me if my case has been assigned to an adjudicator yet.

I called my Senator's office that made some calls last week. The person there called to get an update on my case. She found out that it's been assigned to an adjudicator, since it's over 30 days past the 5 month mark that it will be an expedited case, and said she was told that she can call back in 3 days for an update. So on Monday I'm going to call her again and ask her to call for an update.

We too are NOA1's from 9/23. We have heard nothing. I was told to wait a few more days before we could do a service request. In fact, I was told to wait to April 7th for some odd reason.

i don't understand how they decide which petitions to approve in which order. i had my approval on march 14th and my noa1 on sept 21, now i see people from sept 23 haven't had their noa2s yet? what sense does that make?

I can't figure it out either. I'm Noa 1 sept 16, 2010 and still waiting for background checks to clear.

I was able to put in a Service Request and you guys cant even get to a Tier 2 not fair either =/

I got the service request for an expedite!!!

I was able to talk to a tier 2 representative after dealing with another stand offish call center rep. The officer was very nice gave me no trouble and put in my service request. She said I should hear something back by March 28th. I dont think she necessarily meant a decision but maybe a confirmation email.

So anyway, after a big fight this morning I got an easy call today and got the service request. Its not fair that there really is no rhyme or reason to this. Keep trying guys and hopefully you will get a nice representative on the phone.

Forgot to say I hope you wrote down that ID Tag and Name of that Officer and the Confirmation NR of the Process that was taken place

Update: just called USCIS again. they transfered me all the way to an immigration officer. I was lucky to get someone to actually check on my application. he put me on hold came back and told me the delay on background check is not on me its actually on my fiance since he is in dominican republic but that they got the report back and just need to update information to continue. He stated to me that i will get a definate answer by sunday so to expect an email any day soon with a response. if not to call back monday. Hopefully this is true. will keep fingers crossed.
