Today I called in 3 times this morning and was told 2 diffrent things about my case. when i questioned why expedite was denied i was told because once its doing background checks they can't push the application thru on expedite but that my expedite was approved but it won't start to expedite until background checks comes back. Now i received email stating expedite was denied ???? also questioned email about service request was told they are working on september 11, 2010 applications to give it up to 60 days. When i called back again was able to talk to tier 3 very nice guy that went ahead and let me put in another service request thank you, he also didn't understand why the confusion on the emails on their computer expedite was approved. will update as soon as i receive more info. patience is what i need. Don't give up if u dont get the answer you want to hear call back as i did and was lucky enough to get to tier 3.

Called the USCIS today, as I'm over 6 months.

I actually put a service request after 5 months (on March 1st) and receive an email reply

"the VSC allows 30 days beyond the posted date before the case is considered "Outside of Normal Processing Time" (ONPT). An additional 30 days must be allowed for adjudicative review and processing before we can request expeditious processing based on an ONPT request. If the petition is still pending after 30 days, and once we receive your formal request for expeditious processing, your case will be forwarded to the applicable adjudicative unit for expeditious handling."

So, now I am over 5months+30 days, so I called to file my "formal request for expeditious processing"

First CS rep told me that she can't put service request, since they are currently working on Sep. 11th, and when I asked for Tier 2, she just disconnected me.

I called again, and another CS rep. did file a service request for me. She also told me that the USCIS should get back to me within 5 days, but it might take longer for various reasons, so I don't need to call back if I don't hear anything in 5 days. I couldn't resist asking: since, based on past experiences, I have a reason to believe that I don't hear anything within 5 days, what should I do (and when) once 5 days are over? She just repeated the same line once again...poor girl, what else could she say... :bonk:

The best trick to get a Tier 2 officer on the phone is just tell the Tier 1 person: I just got disconnected with an Immigration Officer can you please reconnect me ?

Arg called today and got through to tier 2 for the first time ever (im way too polite and not insistent enough i guess) That didn't help either :-( I feel like all my calls are for nothing but I can't sit around and do nothing. On another note, I sent an email to the obudsman:

I am writing to you as a citizen of the United States who is applying for a K1 visa for her fiance, a citizen of England. I am concerned with the manner in which the USCIS is handling the processing of I-129f applications for fiance visas at the Vermont Service Center, where my petition is being processed. I am a member of several immigration support websites where people regularly update each other about the progress of their petitions, and it has come to my attention that recently there have been many approvals of these petitions within 1-2 months. I have been waiting for approval for more than 5 1/2 months, since September 28, 2010. These 1-2 month approvals have not all been expedites, and I am concerned that the USCIS is using these quick approvals to keep their average processing times below the 5 month expected processing time. I can see no other reason for why petitions with no request for expeditious processing would be taken and approved so far out of line.

I think that the way the USCIS has been handling the petitioner's enquiries about this situation has also been unsatisfactory. I think that if applications are going to be handled out of order, we, not only as citizens, but as paying customers of the USCIS, deserve at least a truthful explanation as to why this is happening. Also, the website says the expected processing times are updated once monthly, on the 15th, which would be the same day that the support hotline's processing dates are updated. However, the website still lists 5 months as the processing time at VSC, while the hotline updated to say that they are processing petitions from September 11th, which is 6 months ago. I feel that it is unfair to people just beginning this process to see this false information and expect to get approvals within 5 months.

I look forward to your reply in looking into this problem,

Kimberly ****

It would appear that whatever correspondence is entered into by the appliicant, the response is pot luck. At every stage, the USCIS has insured itself against any enquiries (30 day/ 60 day extension, 21st August, 11th Sept etc.) This is massively frustrating mainly because a simple change in the estimate to 7 months (which is wholly unacceptable) would make People feel better and less prone to calling up every day. Why say 5 months if actually what you mean is 5 months PLUS 2 months!? We have sent several emails to various addresses and asked for service requests etc. with no yield and I do wonder now if anything is gained by calling up or whether it can, in fact, have a negative effect. So we wait. And hope. And call again tomorrow. Good luck all.
