Mistake On Green Card - I-551 Stamp ?

Hi everyone!

We recently completed ROC and got the 10 year card in the mail. Unfortunately, there was an error in my birth date that was a simple mistake on USCIS's part. I sent it back last Tuesday and it was delivered to USCIS on Friday along with an I-90 form (check box d) and supporting evidence:

- Copy of 2 year conditional card with correct birth date.

- Copy of I-751 form that was sent in with the correct birth date.

- Copy of the biographic page of my passport showing the correct birth date.

Since it was just a matter of the two numbers of the actual day being switched around and not a completely different month or year error I didn't include a copy of my birth certificate. I also included a cover letter detailing the exact mistake and a request that my card be replaced free of charge.

I have three questions I'd like help with if anyone who's been through this before and knows.

1. Did you get a receipt notice after you filed the I-90 and if so how long did it take? I have travel plans in the next 9 weeks and I understand that if the replacement card doesn't come in a timely fashion to get a I-551 stamp in your passport you need to show the receipt notice at an infopass appointment.

2. How long does the form generally take to process for reason 'd' these days? Trying to project a possible time line.

3. Where do they process the I-90 form now? The instructions said to send the forms and evidence to the Arizona lockbox, which I did. I'm trying to figure out if they forward it to the Service Center that adjudicated your previous case or if they deal with this type of request exclusively in Arizona now.

Thanks for any help offered!

1. You should get the notice of application in 1-2 weeks with case number.

2. It took mine 4-5 months and this was Texas Service Center (end of January - mid June, 2009). I applied long time ago when they still had the old system, meaning I-90 was to be sent to the center where the incorrect card came from.

3. They changed the instructions and the place where you should send I-90 now is Arizona. I do not know if they forward stuff or not and how the system works. But see, when you get the NOA, I guess you will know who deals with your I-90 - Arizona or some Service Center. :)

Hope this helps.

It does help actually and that's a great point about looking at the receipt to see who is processing it so I can look at the processing time chart and have an idea. I will definitely schedule an infopass appointment as soon as I get the receipt so I can get the stamp. Thank you very much.

If it were me: Call them (your asc) if you can, but definitely, schedule a Infopass soon at your nearest center. Bring all pertinent information with you. Copy of I751 filed, 2 & 10 year GC, SS card & drivers license (if you have one) Receipt and all other approval notices, emails etc. Chances are, they have the correct date(s) at your asc & the mistake was made elsewhere. Either way, this will need to be corrected in their system. Otherwise, they 'may' drag their feet and in 9 weeks you are still waiting. JMO

Thanks for the ideas.

I was told to wait until I get the receipt notice for the I-90 before I go to the infopass or they will not give me a stamp. I called USCIS and spoke to a very friendly immigration officer and she told me to call her back in a week if I don't get the receipt in the mail and she will give me the number over the phone which I can tell the officer at the infopass appointment. They can then look it up in the system and verify my I-90 filing before they give me a stamp. It'll all work out and I will come back to this thread to report as I go along.

It sucks that you have to pay for fixing their mistake unsure.gif I wish they would have a special fee waiver for I90's filed due to errors they made..

I didn't pay. I checked box 'd' which is card replacement based on USCIS error and therefore no payment necessary.

Updating on my situation. I went to an INFOPASS appointment this morning and was able to easily get a stamp valid for one year in my passport with the I-90 receipt in hand. The whole process was only a few minutes long and the agent was very kind and helpful.
