Why Submitting 129F

Hi everybody.

It’s Kind a stupid question I am sure which I am going to ask. Hope you all bear it.

I have read on many posts that most likely I-130 & i-129F approved on a same day, And they will cancel 129F, so if they approve them on a same day and going to cancel 129 later, then why submitting 129-F even though processing time of Cr1-IR1 & k3 is almost equal.

That is a good question. Some people think it will speed up their petition and their spouse will arrive in the US sooner, some think the I-129F will be approved before the I-130.

It's a personal choice, in my opinin, it just wastes time

'these people' aren't aware of the change up from 1 FEB 2010.

and that sucks, much.

Could you explain your answer a bit more in detail please? If there are actual problems or requests for additional information when you file the I-130 petition, could the processing potentially take longer than if you "additionally" filed the I-129F after you receive your Notice of Action? I ask because I have just filed the I-130 for my husband and have just received my I-797C Notice of Action. What is my next move? I'm stumped by the sheer volume of information out there and seem to be getting lost somewhere in the mix. Is there any 'one' way I should be moving forward with this?

Your next move is to forget about the I-129F and check out Ling Ches NVC shortcuts.

NVC, since 1 FEB 2010, will administratively close any I-129F that travels TOGETHER with an approved I-130.

If you have doubts on any K-3 - then I strongly suggest to you -

to READ the last 40 topics in the K-3 forum. I (and others) have covered MUCH about

--why it's closed

--time slippage on submitting the I-129F

--why a K-3 isn't needed anymore.

I'm not so happy to retype anything these days, that I've already written - I'll leave it to you to read the posts in the K-3 forum.

I wouldn't dare expect you to retype anything - I know how exhausting this process can be! :wacko: I will definitely dig through these links and appreciate your help. You've given me tons of help in just pointing me in the right direction as I find half the battle is in finding the right information these days.

Ah! Darnell. I just re-read the above statement you wrote and finally the light bulb came on. :bonk:

I've gone over and over the same statement on the Dept of State web site and it just sunk in ... ".. TOGETHER with an approved I-130." That does kind of put the kabosh on the thought of submitting the I-129F. I was stuck in a rut thinking they could not be submitted together as in when 'first submitted' - when in fact it does read "...will close any I-129F that travels together with an approved I-130." That answers my question without a doubt.

Thank you for taking the time to respond. You just saved me a huge headache. Time to walk away from this and clear my head for a few minutes. It's all looking like Greek to me at the moment. Information overload... :blink:

Hang in there, these things 'flesh out' over time.

When I was first learning about the IR-1, I took a stack of greenbar paper, spread it out, and made flowcharts with green crayon.

Every time I learned something new, I'd make a new flowchart.

I still keep several 'current' copies around - one pinned up on my office wall, another I carry with me, another is with my parents.

Green Crayon is Important!

Thank you so much everyone whole heartily appreciate. Now I think it’s a time to forget about 129F and concentrate on 130. Well it’s almost 2 months since I have filled 130 for my spouse and I think it would take around 2 or 3 months more for NOA 2 I guess, or you never know. Well Good Luck to Me as I miss my wife so much, wish to be over soon,

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)
