hi guys. im engaged to a US citizen and not sure which visa we should file for. K-1 or DCF. i was thinking K-1 fiancee visa all along but just discovered DCF. My fiance has been living in Ireland for 22 years. do we qualify for DCF? we want to leave for US together when we get a visa and this makes the affidavit of support nearly impossible as we don't have anyone who can do it for us. my fiance can't file it for me because he will be arriving at the same time as me. any advice? thanks

October 8th- Sent off K-1 visa package

October 21st- Received email saying we have been assigned to CSC

October 28th- Waiting on NOA1

October 29th- NOA1 received!!!

March 16th 2011- Received email saying petition for fiance has been approved and that NOA2 is in the mail!

April 12th 2011- Waiting on lettter with interview date from Dublin Embassy. Medical scheduled for 26th April

DCF is for married couples. So there is one more step before that can be filed.

Regardless of visa type an affidavit of support will be required of the US citizen. If they cannot meet the income/asset requirements then a co/joint sponsor will be needed.

Also the US citizen will need to establish domicile in the US.

If you are sure there are no US based friends or family who can co-sponsor, and you have no assets to sponsor with (which is how we got around the issue when doing DCF in Ireland), then your only option is the K1- or CR-1 spousal visa filed in the USA. Ie your USC partner goes back first, finds a job, then petitions you.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

From what I know, DCF will probably be faster and more simple than the K-1 or even the IR-1/CR-1 filed in the US.

Your best shot for DCF would require you to secure a joint-sponsor or assets to comply with the requirements of the i-864 Affidavit of Support.

Thanks everyone, I know DCF is for maried couples but they encourage you to begin collecting information when engaged. We could also do the legal part of the marriage and then apply without having a big wedding.

Does anyone know if it is possible to have someone from home, ie: an Irish family member sponsor you?

We have an address and a place to live, but no sponsor for the affidavit
