hey,

we are in the same process and I was wondering if the copy of marriage certificate has to be notarized or not?

No, everything for the application can be a normal photocopy. Be sure to have the real thing ready to present at your interview for verification.

oh, thank you! because in the guideline it says "a certified copy of your certified marriage certificate.." so, I guess we don't have to notarize the copy of the marriage certificate.

Your I-130 is correct.

For the I-485, it is curently $930 + $80 for biometrics = $1010

You can just pay one check for $1010.

The I-765 is free IF included with the I-485 packet.

This is in the current I-485 instrutions, which is where you should look for this stuff (make sure you have the most updated version of the I-485 and all is good).

What guide said certified copy of marriage cert? The VJ guide?

Yeah, I just looked at it too. It is wrong. I checked the I-130 instructions on USCIS website and it says only a copy. We submitted only a copy and never got asked about it (of course we brought the original with us to the interview as requested).

Anyway, maybe we can get a mod to update that outdated info?

http://www.uscis.gov/files/form/i-130instr.pdf

Page 2 here says just a copy.

Good luck.

oh, that's very good then that we don't have to certify the copies. I had one more question though - they require for the USC's birth certificate, but on his birth certificate it says it's illegal to duplicate or make copy of birth certificate, so, does it apply in any situation or is it ok to make a copy of USC's birth certificate and send it, or should we order a copy of his birth certificate and send that one? what did you do guys in this situation?

I say it's fine to make a photocopy.

You could also just include a photocopy of the USC Passport if you are concerned about the birth certificate. You just need something to show that he is a US Citizen, and either of those (Passport OR birth certificate) prove that.

This is also in the instructions from USCIS, linked above. Have a really careful read? :)
