I-129F Part C question

Hello all,

I am a middle aged woman. Soon I will be filing a I-129F so that my Norwegian fiance can come to the US. We have known each other since August 2006, became a couple in April 2007, I have been to Norway 8 times. He popped the question on August 9, 2010. I am probably worrying over nothing but to me better safe than sorry.

My question is due to Part C (this is what happened)

On February 25, 2007 in the town where I reside I was charged with Harassment 2nd degree and was released on my own recognizance and was scheduled to appear at the local Town Hall on February 28, 2007. On that date I appeared in front of the judge pled "guilty" and was charged with the violation of Harassment 2nd degree and paid a fine of $100.00.

If I am not mistaken I would answer "NO" because there is nothing in Part C #2 pertaining to the above? Did I over look anything? Any guidance would be helpful.

Personally I have no problem with sending a note about the above but more specific mentioning where this happened with the application in about this event. This occurrence is something my boyfriend knows happened. I have nothing to hide and would rather not look as if I am trying to hide anything.

I figure the violation can not be too bad as I have had a background check after that event when New York State required our agency to do background checks because we work with Developmentally Disabled adults.. under the supervision of the New York State Department of Health.

Fishing through the USCIS website is becoming increasingly futile, but without having their definition of "domestic violence" handy, this is what I would do:

I would answer 'no' to the question and include an explanation with your petition. List it on your table of contents, make a separate page with the appropriate identifying information, reference the section and question on the I-129F, and quote much of the same information about the incident you have provided here.

Was the charge in regards to a current or former family member or ex boyfriend? Also, I assume it was a midemeanor, Is that correct?

No it was only a violation... like a traffic ticket

Doesn't appear to fall under any of the crimes listed on the instructions (unless your state considers this particular one "stalking" or "dating violence")

If it doesn't, you do not have to list it or mention it.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
