I said the CO is instructed not to readjudicate the case.

Here is a lawyer's interpretation of the cable and the link to the actual cable; I will let you draw your own conclusion.

Petitions are not 'the case'.

The cable notes that consulates should not readjudicate petitions that have been approved by INS, since the approval of the petition leads to a presumption in favor of eligibility for the visa.

Terminology is important in immigration (and in other matters of the law, where the law often defines terms to have meanings that can be quite different from their dictionary or steet meanings. Using the wrong word on immigration issues can totally change the meaning of something in important ways.

If you'd said that you meant only the petition in your post I would not have challenged you about it.

When France wouldn't back the US' plan to invade Iraq (or liberate Iraq depending on who you talk to!), GWBush declared that "French" fries should be known as "Freedom" fries instead. It was a 'thumb your nose at the French' tactic.

edit: and before the "don't bash Bush" people show up, I don't know who exactly 'declared' it but it was from the White House. Feel free to correct me if that's wrong. :)

Neither President nor anyone from the White House re-named the french fries as freedom fries. It was Republican Congressmen Bob Ney and Walter Jones who led the effort to re-name the french fries as freedom fries at the House Cafeterias at the Capitol Building which they succeeded as a patriotic protest for the France Government's vehement oppostion of the Iraq war in 2003. The latest update is, they re-named the freedom fries as french fries at the House cafeterias which hardly got any media coverage. So it is french fries again.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Thanks for the additional info on the freedom fries, simple_male! I appreciate you correcting me. :thumbs: I confess that all I truly remembered about it was that it was something with the White House cafeteria and GW Bush's name got thrown in, in the article I'd read. I was still living in Canada at the time, so it was peripheral to my world. :)
