john_and_marlene - I did not make any negative comments concerning the usefulness of his information, label anyone a troll, or single anyone out. He quoted me and I simply responded to the quote… That was it! I'm not concerned about creating fanfare resulting in a bandwagon. That's shallow! Even with the direct questions that I have raised in this forum, there were only few responses and I expect that because this forum does not host many VJers at one particular time, at least that I've noticed. I just posted what I was thinking at the time. Honestly, I love being able to use the forums to commutate, laugh, learn, and grow with others experiencing like situations as an outlet from the madness. Hopefully this situation will not hurt our potential to share ideas in the future.

john_and_marlene - Why would I post in the off topic forum concerning my analogy of how our cases are viewed at the Embassy level? There can be useful information passed commingled with a bit of fun and parody sparking conversation on any subject matter or thread. The disconnect only existed because I took offense to what "Yodrak" wrote. If he feels like the analogy doesn't make sense, then why post in this thread. He could have easily PM'd whomever he wanted to relay information or simply posted his what he wanted minus the ensuing negative comment. That was my only point and contention. I presume that I'm accustomed to the K1 forum where questions, ideas, comments, opinions or whatever are raised without scrutiny and judgment. Thus far, I have only see trolls scrutinizing folks. I apologize for presuming that the same type of love exited in this forum. For the future, I will only post direct questions in this forum to avoid this type of confusion/dialog.

I guess I'd like to weigh in on this because the original question made allot of sense to me. I can't help but notice that my response was different than the majority of others. I'm not sure if was because I'm among the few who "Got It" or not. If you go back to the original question Uling wrote " What do you perceive...."

It's the word perceive that I focused on. Uling did not ask what is the reality. Most everybody responded with the facts, the reality.... The burden of proof is on the beneficiary which is absolutely correct. In my view this is a given. I took the question to mean how do we FEEL about the interview process. This question should have generated a variety of responses depending on location of consulate, personal circumstances, pre interview process/post interview experience. I feel....there's that word again....that the value of threads/discussions is two fold. 1 to exchange technical information, meaning immigration rules, regs & processes. 2. To discuss/share our experiences and thoughts on how the immigration process has affected us.

P.S. Uling thanks for the info on the flags !!!

ceriserose - You made some great points. When I wrote "..work with me... Gsss!" I was just goofing off having fun especially because I saw that vartan was around. He and I have shared ideas and had brief dialogs in the past. You are right! I should have attempted to clarify what I thoughting.

Thanks for the post...

It's an analogy PEOPLE... I'm well aware that it's not a guilty or innocent process. Work with me... Gssss!!!

john_and_marlene - Writing that I have only seen trolls scrutinizing folk does not mean that I am calling anyone a troll. There is a difference.

Perception is relative. I don't operate on a personal paradigm that others will be viewing and evaluating me on a guilty or innocent basis. I don't operate on that basis with others. How I view this process and how I discuss it is uniquely me. I don't expect everyone else to do that, nor do I call them trolls when they don't. However, if the end goal is to discuss, learn, interpret and understand viewpoints, it's nearly impossible to achieve if one isn't willing to diversify in communicating.

Of course, that's just my opinion.

And since Uling hasn't responded to me directly once on this so for all I know my posts are invisible.

I'm out.

edit: go me! timing is all well! I just saw your reply. It's all good. Maybe just remember that I have no idea who you and vartan are and joking around can be misconstrued. :)

Yodrak - Loosen up buddy! You don't see me raining on your parade. The whole purpose is to get a flavor for what people think and create dialog. I'm just here to have fun, learn, and exchange ideas. If you want to participate then GREAT, other than that please take your condescension to someone else's thread.

Don't be such a BUZZ KILL.

Goodness gracious!

you posted something intresting you wanted perspectives. this is good because, there are those

I said the CO is instructed not to readjudicate the case.

Here is a lawyer's interpretation of the cable and the link to the actual cable; I will let you draw your own conclusion.

Petitions are not 'the case'.

http://www.murthy.com/news/ukdosapp.html

The cable notes that consulates should not readjudicate petitions that have been approved by INS, since the approval of the petition leads to a presumption in favor of eligibility for the visa.

(seems that is holding true based on your statement here)

Fair enough. I too have people that I'll joke with and tease on here because we know each others' boundaries. My only point is that people can take it out of context because they don't have the inside scoop.

No freedom fries for you! Come back one year. :P

Hmmmmmm.....I got the analogy and its one I have even thought of to myself, so I can totally see where your coming from Uling. However, given the past 5 years I can understand why our country has to scrutinize all applicants......Its just sad that it has to be this way.

Completely sympathizing with you Shonie......I am anxious for you myslef. Hope the day comes soon that you post on here that your hubby is coming home soon!

Another way to approach it (where *is* that dead horse smiley?) is this: if there are assumptions or perceptions based on misinformation, correcting the misinformation might change (correct) the perception.

Personally, I always approached USCIS and DOS as professionals from whom I wanted something that I was entitled to get. I knew we had a legitimate relationship, I knew that I was a US citizen, I knew my beneficiary didn't have any disqualifiers lurking in the background. We didn't kiss any butts, make any voodoo pledges or (mainly) over obsess about our paperwork other than attention to detail.

We weren't guilty of anything, we were just applying for a straightforward benefit. It's a ton of bureauocracy and red tape, but you just play the game by their rules and get your desired result.
