Hi,

When I came to the US I got a driver's license. It is now expiring, and I realize the date it expires is the same date my visa (F-1) expires - it's about 10 months after the date I was issued it.

I'm currently waiting for a family-based AOS, and I want to keep my driver's license. Can I get a renewal of my driver's license for the period between my permanent residency and my visa expires? Is it just a coincidence that my driver's license expires the same time my visa does?

07/12/2010: USCIS sent NOA1 (FedEx receipt 07/09/2010)

07/27/2010: Did walk-in biometrics in Fresno, CA (Scheduled appointment was 08/14/2010 in San Marcos, CA)

07/27/2010: Requested expedited processing of I-765 due to financial hardship

07/27/2010: RFE (I-864 instead of I-864EZ) - expedited processing cancelled.

08/09/2010: I-131 delivered to USCIS (according to USPS)

08/13/2010: RFE response NAO received per e-mail. (USPS receipt 08/11/2010)

08/16/2010: Requested expedited processing again.

08/24/2010: Contacted Representative about help. Inquired to USCIS, told us they couldn't ask for any kind of preferred processing, and gave us status update (At the "judicial stage of the process"?)

08/25/2010: Work permit card production ordered!

no, your licence will expire the day that you are no longer legal in the US. For them that is the date your F-1 visa expires. You should bring into the DOT your AOS packet with the NOA and they should extend it.

Check your local DOT for verification since this is based state to state

The expiry date is not coincidental--that was done as a ham-handed response to 9-11, and causes bulkerloads of migraines for temp-visa-holders.

Hi, same thing happened to my husband. Since you are adjusting status, the federal gov. does not consider you a resident, but CA does. It's rule is anyone here over 10 days is a resident and must drive with a CA license. My husband got pulled over and given a ticket for driving with his Australian license. He went and applied for a CA license, but it was only valid for one month when his I-94 expired. He has been in limbo since.

He just received his employement authorization card and will be going back to the DMV to get his license renewed with that. It should give him one year and then I think he will have to go back with his conditional green card to get is extended again.

You will be rolling the dice driving from now on until you get the extension. It looks like your EAD card is on the way so you can use that to get your license back.
