I have been living on and off in the United States for almost 8 years.I am British and i got married in June 2007 and renewed our vows for family and friends on our anniversary in June 2008. Unfortunetely my husband became more and more controlling, mean and agressive towards me and would find fault with everything i did. I loved him very much but couldnt seem to do anything right. It was a nightmare so i eventually built up the strength to leave him in September 2009 on a trial seperation to see if we would miss each other. I was homeless and he was very bitter towards me. I had to return to Scotland to be with my family and think things through. When i get back i arrange for my husband to stay with my best friend whilst on a trip to london. Whilst he was away i was checking my emails on my laptop which automatically signed my husband in. Never before had i looked, i trusted him on that he wouldnt cheat. There it was the email correspondance back and forth with this girl that i knew and had been at several functions and parties with. I was destroyed and completely broken hearted. I couldnt believe he could do this. Eventually i filed for divorce in december as i knew i couldnt take him back. Turns out 2 weeks after i left him she was already staying over at our marital home which she eventaully moved into over January. Not even divorced and she has moved in. I was sickened. Anyway now i am petitioning to apply for my 10 year green card without him and i have plenty of evidence to support the marriage and have a fantastic job that have been very supportive since we live in a very small town and i am scared to run into anyone associated with him. Unfortunetely a month ago i got pulled over and done for a DUI. I never do this normally but circumstances led me to drive and i did. I understand that and it was a mistake but has anyone had this happen to them and/or can offer any advice on this situation. I have been in counselling and abusive counselling to help me come to terms with my failed marriage and the cheating and i struggle everyday with it as i wanted us to work. Unfortunetely this man is always right and i was always wrong and the next step would have been physical abuse had i not left when i did. I still love him but have refused to have any contact with him as it just upsets me. Any advice would be wonderful.

One of the things that first comes up is do you have evidence of his actions? You need some evidence to support the reason(s) for leaving and divorcing him. You need to show that it is not immigration related marriage.

The DUI might raise some questions, but all in all, I think it should be fine. Just keep records of all the counseling and any actions you took to show you are not going to repeat this offense.

One of the things that first comes up is do you have evidence of his actions? You need some evidence to support the reason(s) for leaving and divorcing him. You need to show that it is not immigration related marriage.

The DUI might raise some questions, but all in all, I think it should be fine. Just keep records of all the counseling and any actions you took to show you are not going to repeat this offense.

I printed off the emails they had written to each other and then he recently wrote me a letter admitting that he rushed the marriage and tried to change me but we fought a lot and couldnt take it and what he did with the other girl was wrong and he has to live with for the rest of his life. the shame and the guilt with always be with him blah blah blah.

Actually all you need to demonstrate that the marriage was entered into "in good faith". Best sources of that is evidence of financial co-mingling such as joint accounts, bills etc. Being able to prove the mental abuse & cheating on his part may support you motives but I would still bring proof that you lived together and co-mingled finances.

i have all of that of joint bank account, insurance, car loan, phone agreement, tax return forms for 2 years along side affidavit sworn testaments from people, letter of support from my work, counsellor and safety network, a letter from my ex indicating his adultery, postcards i sent him over the 5 years and the adultery emails they wrote. surely that has got to be proof enough.

What about the DUI. Do you think that will affect my case? I just want all this stuff taken care of :( It really can get to you.

IMO, if you are a repeat offender, then they will frown at you... but if it is a single time, well, we are human and prone to mistakes! You need to show them if they ask good moral (before and after) so I don't see that it will pose a huge problem. Be honest about it and that should be a good path to take

again, this is my opinion.

Thank you everyone for your input. I have spent the day photocopying all the documents so to be submitted very soon. Will i still be able to travel. I read that having a dui may result in me to not be admitted back into the country until all is resolved with my claim. Will they want an interview with me regarding the breakup of marriage?

Hi there to anyone who is in a similar sitiuation. I have submitted my forms for removal of conditions on my own as i am now divorced. I got my letter several days later extending my 10 year greencard which i am very happy about. I submitted all the evidence of my marriage including photos, cards, joint bank account, joint tax returns, joint car ownership, his adultry emails, a letter from an abusive center indicating i was in an abusive relationship, letter from my counselling center, and lots of affidavits of support and character references. How long does it take to get the next stage with fingerprints etc and overall how long should it take. Has anyone been in the same situation. I did love my husband but wow he was mean to me and totally destroyed my inner self. I am only now just getting back on my feet and feeling good about life.

any info is great
