Question 38. Have you ever been refused admission to the US, or....

My fiancee did get refused on a student visa last year. Is that the same as being refused admission or is that just at a port of entry?

I've asked before, but Question 31. Have you ever been refused a U.S. Visa? I think we have to put yes here and put in her student visa...I was told this shouldn't affect the K-1, but it looks like a question they could give us flak about.

Thanks

for Q.38, I understood it as refused entry at a POE (Port Of Entry) by a CBP officer. So a denied VISA doesn't apply to this question but as you said you have to mention it for Q.31

Take this with caution as it is only my interpretation and I may be wrong. If I am wrong I hope someone will correct me.

Good luck on your journey

Bruno

Question 38. Have you ever been refused admission to the US, or....

This is a POE redusal of entry. In your case, No.

My fiancee did get refused on a student visa last year. Is that the same as being refused admission or is that just at a port of entry?

I've asked before, but Question 31. Have you ever been refused a U.S. Visa?

IN your case, Yes, the student visa. Dont' worry be truthful, they will check your answer against their records. If they match, then you should be good to go.

I think we have to put yes here and put in her student visa...I was told this shouldn't affect the K-1, but it looks like a question they could give us flak about.

Thanks

She has NOT been refused entry. She HAS been denied a visa. Answer truthfully. Neither will affect your K-1
