Previous 221g will NOT be an issue. That's totally a different visa issue and that chapter is closed.

There are some red flags that you need to overcome, because it is a very rare situation for an Indian to go for a mixed marriage like this. Parents' disapproval is not an issue. Language is also not an issue since you can coomunicate in English with her. However, you need excessive evidence to show the "bonafide relationship" with your fiancee to overcome some red flags (Age difference and mixed race).

These excessive evidence must be in a progressive way how the relationship is evolved. Gather all documents from day 1 until the interview such as online meeting details, her visit (passport stamps), chat history, phone history, hotel receipts, vacation details, gift details, greeting cards in all occasions, mingling with her family if possible, just to name a few.

Start with K1 Finace visa by filing I-129F as Anh Map suggested. If there is any issue, get married and file I-130 for IR1/CR1 path.

I had an employment visa back in 1996 and denied with 221g. The reason was I appeared in a wrong consulate (Mumbai) than Chennai. Then I lost my interest to pursue it in 1996. Later in 1999, appeared for another employment visa in Chennai and approved and came to the U.S. They didn't even ask a single question about the past rejection, but the 221g stamp was on my passport. Hope this helps out!

The reason I went to Mumbai was - I was more familiar with Mumbai at that time.

I agree with Carolyn front load your petition with overdrive. My husband is Indian and I am black. Not much of an age difference. I would say talk to your family since the embassy will pay attention to how well she is accepted. Just my opinion. We went thru immigration process twice. One with no pics with his family (fiancé visa) and another with affidavits and several pics with his family (spouse visa) . Spouse visa was no problem getting approved. Fiancé visa suffered a denial.

1. older fiancee--may get some scrutiny, but not a straight-off disqualifier

3. parental disapproval--well, you are of legal age to marry (whether in US or India) without anyone's consent

I agree with all the above - on the face of it you should qualify for the visa and you don't need parental approval.

However, in the interview process they will want to see documentation (usually photos)

showing how your family gets along with your fiancée. If you think you can win them over

in the number of months it will take to arrive at the interview stage, it's worth a try.

When you are only a couple, you focus just on the couple. Once you are married, other (including family)

considerations come into play, adding stress, drama and sometimes discord. If you feel you're up to that

and can handle anything that may come your way. With my first marriage (Japanese, younger than me)

the drama that she created finally broke us apart. Drama can come from anywhere and sometimes

it's lethal. Be strong and confident and learn to deal with it together. You will need that resolve.
