Indian planning to marry older black american women

Hello All,

I am 29 old man working in india, i met women aged 40 online and we decided to get marry. She is planning to visit me in November and once she leave i will apply for an fiancee visa.

I would like to know from all you honest opinion about how to prepare for myself for the process.

1. I am 29 and she is 40 black american, myself applied H1b in year 2008 and got 221g, but didn't respond to it and got expired.

2.Have travelled UK twice on a work permit.

3. My parents will not agree myself marrying someone older and from outside our race.so i am planning to keep it as a secret from them.

4.Planning to show evidence of ourself took pictures together ,hotel reciept and engagement ring reciept.

You do not begin the process, the US citizen does by submitting the I-129F petition.

Thanks.My question would be whether age difference/different race parents disapproval ,my H1b visa 221g in 2008 will have an impact on my application. If yes.how can i tackle this.

It depends on the norms for the region where you come from. The age difference shouldn't be a big deal (though an older female petitioner is less common, it's not rare. Others from India can provide more specific answers. You may want to post your question in the Asia: South forum to get more consulate specific input.

The prior visa should not matter. It's demonstrating the bona fides of your relationship that is important. Document your correspondence/communication along with your time together.

The further you go from what would be normal for your culture the harder it will be. If engagement parties are normal not having them will raise a flag. If your wife to be is older that will raise a flag. If she is past child bearing age it will be a double flag. If you have NO pictures with family and friends that will be a flag. If it is not normal to marry outside your race and you do that will be a flag, if there is a large income difference that will be a flag. The more flags the more issues you will have

We cannot tell you for sure whether you will be approved or not; a lot will depend on what bonafide relationship evidence you have (photos, emails, phone calls etc).

The age and race difference will be a red flag, especially if this is unusual in your culture. Combines with your parents' disapproval, and only one visit will make it more difficult to get approved. As to the previous visa issue, why did you get the 221g?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

We cannot tell you for sure whether you will be approved or not; a lot will depend on what bonafide relationship evidence you have (photos, emails, phone calls etc).

The age and race difference will be a red flag, especially if this is unusual in your culture. Combines with your parents' disapproval, and only one visit will make it more difficult to get approved. As to the previous visa issue, why did you get the 221g?

regarding 221g, the US embassy asked me to submit more letters from employer who sponsoring my visa and also client letter

Previous 221g will NOT be an issue. That's totally a different visa issue and that chapter is closed.

There are some red flags that you need to overcome, because it is a very rare situation for an Indian to go for a mixed marriage like this. Parents' disapproval is not an issue. Language is also not an issue since you can coomunicate in English with her. However, you need excessive evidence to show the "bonafide relationship" with your fiancee to overcome some red flags (Age difference and mixed race).

These excessive evidence must be in a progressive way how the relationship is evolved. Gather all documents from day 1 until the interview such as online meeting details, her visit (passport stamps), chat history, phone history, hotel receipts, vacation details, gift details, greeting cards in all occasions, mingling with her family if possible, just to name a few.

Start with K1 Finace visa by filing I-129F as Anh Map suggested. If there is any issue, get married and file I-130 for IR1/CR1 path.

I agree with the other members in many ways. Yes, it would have to be HER, the US citizen, who files the petition and not you. While there seem to be people approved with age differences, it is usually the male petitioner who is the older person. Yet, this should not be an automatic denial. At the time of your interview in your consulate the officer might get suspicious if you did not follow the customs particular to your culture (engagement ceremony, parental consent, meeting the family, etc.) That is why it will be super important to gather as much evidence as possible of your relationship. So, start gathering evidence now in preparation for potential skepticism. As other members suggested, you should read the guides and check out the regional forums and possibly obtain specific advice from other beneficiaries from India. Best wishes!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

I am Black and my husband is Pakistani. I am also much, much older than my husband. He is 23 and I am 50. We were approved for our visa and I really think it's because we front loaded our petition. That means we sent wedding pictures of me with his family, phone bills, emails and we both sent letters explaining and giving a time line of our relationship. I also spent 2 full months with him in Pakistan. I spent 1 month before we got married and 1 month after we got married.

My husband's interview was very easy. She just asked him a few questions and asked to read some of our emails.

I think you should do the same and front load your petition with as much information as possible. Also can she be at the interview with you? That would help a great deal if she could be there. Learn as much about her as you can so you are ready to answer any questions they might ask. Try not to worry too much about her being Black and older than you. Just be very prepared for your interview. Read about the interviews other people have had in your Country. Practice the questions they were asked.

To clarify, Darnell means that your US citizen fiancé must apply for the fiancé visa, not you.
