I have a possible issue and unsure how to approach this. I have sent my fiance the I-864 and other evidence for his interview on Oct. 5th. I was just hired this past week for a job and (orientation is today) so I have not officially started working yet. However, I sent the letter of employment along with the I-864 just in case.

Now my issue is, yesterday, another company is interested in hiring me which is a better job, but this job will most likely not take place until the end of September which is so close to his interview. If they hire me, how would that work since I have already submitted an original/singed I-864 with current part-time job. From my understanding the I-864 has to be an original not a fax version. I wish, I could extend his interview date but from what others have said this is not a good idea, since I am dealing with Morocco. I am afraid, I will get an REF for sure since I cannot submit any pay stubs along with this I-864.

So.... if I get a new job so late in the month, how can I submit this I-864 with a new income so quickly by his interview date?

Thanks for any advice.

Why did you send the I-864? it supposed to be the I-134 since you are applying for a K-1 Visa

you should check it out

God bless

My suggestion is not to worry about it. Does your current job (as in the one you used on the I-864) meet the poverty requirements? If so, then it should be enough. If you get a new job, a letter from your employer stating your salary and such could just be used to supplement the evidence of financial stability that you have already submitted for your fiances interview. As long as your I-864 meets the requirements you should be all set! I hope everything works out!

Why did you send the letter of employment when today is your first day of orientation? The I-864 is not a form that you can fill out with future information, you needed to put down what your income at the time that you signed it was, and then you have orientation today and now interested in another job and you now want to send new forms, seems outrages when its so close to your interview date doesnt it? :bonk:

Don't worry about it. If you qualify now, that's fine. It is a K-1, the initial affidavit is of little value, you will have to do it again for the AOS. Your ony obligation is that the information was accurate the day you signed the form. Does Morroco require the I-864 for a fiancee visa? Usually it is the I-134, if any. The I-864 is usually for the AOS after you get married, but it is consulate specific.

Just a reminder, In Morocco the I-134 is no longer being used. The I-864 is what is required now during the initial interview.

that answers that...ok

Well first of all, I was without a job and never had to work the last 12 years, and secondly, I just graduated and it's hard to find a job so soon, but I did.

I sent the letter of employment because it shows that I was hired on September 7th and I have no time to wait around since the mail systems takes forever to get to Morocco. Orientation was just to get my job schedule for Monday and show proof of insurance, nothing more.

To answer you second question re: new job so close to interview:

Ummmmm yes, if you were offered a job that paid 3x the amount and was full time, don't you think you would reconsider the I-864 form you sent prior with lower income figures, and submit a new letter of employment making three x's that amount. It means the CO make take a closer look our situation and grant us a VISA instead of a denied VISA due to income.
