Our son was born on July 28th, 2010.

Yesterday, we visited to pick up our son's birth certificate from the County of Los Angeles they do not have available.

I was told to wait until after the 2nd month until the birth certificate will be available.

At this time, we are ready to submit the I-751, but I am thinking if I should wait another three weeks for our child's birth certificate.

My wife's conditional GC expires on December 5, 2010.

My list for the I-751 packet is as follows:

• Application fee - $465 (plus $80 biometric service fee) in a check of $545.00

• Form I-751

• Copy of Permanent Resident Card (Form I-551)

• Copy 2009 and 2008 US Federal and State Tax Return (Form 1040 and W2)

• Copy of bank verification letter from Bank of America

• Copy of joint membership and credit card accounts

• Copy of fixed annuity statements addressing Mrs. Dr. Mirage as beneficiary

• Copy of joint auto insurance policy

• Copy of joint utility bills (LADPW and Gas Company)

• Copy of Cord Blood Registry certificate

• Copy of hospital record with father and mother's names

• Copy of baby's first arrival certificate

• Copy of baby registry

• Copy of cell phone statements

• Copies of Christmas cards, invitations and church certificates

• Affidavits by U.S Citizens attesting to our relationship and marriage

• Copies of ticket stubs from sports games and events

• Copies of trip itineraries

• Copies of photos

Does anyone think that I should wait for the birth certificate.

We originally planned to submit this on 9/9/10.

what was the fee to pay for the expedite with the County?

If you think you absolutely need the birth certificate, then you can wait for it. That means you'll be filing late September early October which isn't bad since your card doesn't expire till December. Judging from you evidence you listed, you do not NEED your son's birth certificate to tell anyone you are living together and married. You can throw in a family picture with the baby if you want. You shouldn't lose sleep over this because you have more than enough evidence. Good luck.

Thanks for the responses. The City of Los Angeles Registrar did not give me an option to expedite. I know that it takes two months after the child is born to get the SSN in the mail and they cannot provide a birth certificate w/o the SSN I think.

As far as evidence is concerned, my wife mentioned that the evidence we have is sufficient, however I just would like to provide this document because on the USCIS instruction sheet.

It is natural for married couple with a child to want to send the birth certificate as the "best" evidence. However it is not of any importance than the other evidences listed NOA. If USCIs makes it a priority, they will be discriminating against those who do not have kids yet or do not want kids period. No matter how they arrange the list, something is bound to be #1 on the list but that shouldn't be interpreted to mean a MUST have evidence or the most important. Your wife is right. You will be fine without it looking at the evidence you already have. You are good to go.
