Delayed USCIS CASES

Timeline

I have filed form I-129f (Petition for fiancee) on Feb 16th,2010 and I received a receiving notice on Feb 20th,2010. Petition was filed with California Service Center (CSC). Normal processing time for these type of cases are about 5 month according to United States Citizen & Immigration Service (USCIS) website. Since then I have not received any letter. I have contacted the NCSC, which is not helpful at all. Then I emailed the USCIS-CSC and I got a response back saying that back ground check is not complete and they can not render a decision. How long dose it will take them to process the case. This situation is getting way out of control. Please help me and let me know what I should do in this type of situation.

Sam, I guess you would have been better off being stuck with original I-130 form, because now that petition might become available before the K3. I think USCIS is lieing on their sites about the estimate processing times. Most of people are not getting things done in time what the USCIS claims. by the way which country is your family coming from?

to file k3 visa, there must be a I-130 petition pending for you. Which usually takes about 8-9 months and once you get the visa you just directly get the green card. But k3 visa is to make the process faster so couples can be together soon, in your case that is not seems to be working.

Hi Sam.

1-- any I-129F filed after the I-130, in hopes of a K-3 visa, actually delays the I-130 processing anywhere from 2 weeks to 11 weeks - the I-130 loses it's place in queue, taking instead the queue place of the I-129F.

2-- any K-3 visa holder must pay more money for adjustment of status case in the USA, after they arrive is no SSN available until green card in hand.

3-- Since 1 FEB 2010, NVC usually closes the I-129F when it travels INTO NVC with the approved I-130.

Ya, you'd be better off to forget about the K-3, in it's entirety.
