Hello!

I am a LPR and I have applied for my wife and my children (a boy and a girl). I sent 3 I-130 in January/2010 and now, on August, we have received the I-797, saying that our petitions were aproved and send to NVC at Portsmouth, NH. (I will detail my timeline after).

As my family is in Brazil, I am not living there until get their process. So, every 6 months I have to go to US and stay a week.

I have some questions that I hope you can help me...

1 - From now, how long it will take to finish the process (more or less)?

2 - There is a problem staying outside US for every 6 months?

3 - As the process is aprooved, I thought try a tourist visa, saying that I want celebrate the Xmas and new year together with my family. Is it possible? Did anyone try? Can causes trouble? They will not stay illegal, just 1 month.

As an LPR, living in Brasil and spending a week in the US every 6 months is a risky business. You might be lucky and not have immigration pick up on it but they can at any time consider you have abandoned your status since your residence seems to be in Brasil. It is true that stays of up to 6 months are not abandonment of status but when you do it every 6 months with only a week in between trips then that's where they could decide you're not longer a permanent resident.

wow...I am really scared now :o

I went to US, to start living there...But I were weak and I missed my son a lot. As I grown without my father since my 9 years old, I was affraid my son grow with his father away...And after 3 months, I returned to Brazil.

How long it will take until complete the process for my family? Does anyone know?

Any tips about my situation are welcome.

u are lucky that it's not taking long.. other ways LPR petitioned for child taken 5 years or lowest 4 years u are damn lucky.. so now what ever u get u try to be happy cause it's not taking u those 5 or 4 years..

But did USCIS/NVC change their proccess, to getting faster? Why is so "fast" now?

How and when did you obtain your GC.

Why were your wife and children not included.

My wife and my children were not included because I was a stupid. As my process took to long, during the process I got married and a son. I was affraid that if I include them, I would have problems. And another thing was that in the week I had my interview, my wife was pregnant and she had a problem with her placenta and she had to rest for almost 1 month, just walking to bathroom and to eat.

I rather think that was not the right moment for us.

But why did you ask about how I got my GC? :huh:

Just in case you had been sponsored by a parent as a single child when you were married.

I see...My sister applied for me. And it took 14 years to complete the immigration process. When start the process I had 13 years, I was single, even imagine having a girlfriend or marriage. In 14 years many things happens :lol:. I made my university, I married, children and when NVC contact, to finish the process, my sister were affraid to include my family, as she started my process when I were single.

Then, when my GC arraived, I applied for then. Now its just wait. While waiting the answer from NVC, I will try to get a tourist visa for my children (my wife already has) and expend, like a vacation, 1 month in US.

Do you think that could be any problem trying a tourist visa for the children, with an approved process from USCIS?

If they give the turist visa for them, they can have any problem/questioning at airpost's immigration?

That is not bad bad. Like you said they could have just been included in your GC as derivatives.

Brazil plus tourist visa's is not a given and in your situation doubly difficult. But you can only try.

Hello,

Yesterday I have received a letter from NVC with the case number assigned.

Now, I have some questions...

I have applied for my wife and our 2 children. I received a letter from NVC with the case number and also, a Affidavit of Support (AOS) Processing Fee Bill Invoice of US$ 88,00 and also, a DS-3032 form (Choice of Agent). But only for my wife. I did not receive any letter about my children (or did not arrive yet).

They should send the same letter, fee and choice of agent for my children too? Just in case, my son has 5 years old and my daughter has 1 year old.

Another question...I have scanned the DS-3032 form but the quality was not so good. There is any trouble to send a scanned form to NVC? Because it takes several days until the letter arrive in Brazil...

Last question (I promise :D) Can I send the DS-3032 form direct to NVC, from Brazil? Or is better to send from US?
