Can I send the I129f

My fiancee is currently in the States on a vacation visa (German). Can I send the I129f while she is in the States or must we wait until she is back in Germany?

Yes you can file the I-129F whilst she is there. Ensure there is no overstay and that she returns to her country of residence for the interview.

Send it in. Like Aussiewench said, as long as she returns in time, no problem. It is actually better for you to go ahead and get it done while she's here, you can do all the paperwork together and get plenty of photographic evidence, etc. It's a benefit. Use it!

We got everything together while he was here with me and sent it off the day he left for England. So go ahead and send it. Good luck to you both .

We did that also. I mailed it about 4 days before he left. Gave us a chance to check over the paperwork and we took some pictures in front of signs to send. We also went to Sears and got 4 passport pictures each. I didn't need that many but he did for the rest of the process. The Indiana department of parks and recreation signs came in handy.

Hi my fiance is also German. He came to the US to visit me on a I94 and we had the very same concern, so I called the USCIS and asked the same questions. They told me that as long as my fiance is visiting and not violating the 90 day maximum stay of his I94 the I129F can be filed no matter where my fiance is, here in the US or back in Germany.

We sent in the petition while I was in the States. On one of the forms it asked about visits to the US. I wrote that I was currently in the States on 90 day VWP, the date I had entered and the date I was leaving. I thought it was wise to be completely upfront and demonstrate my intention to leave the States within the allowed time rather than risk an RFE. I think I may have also included a copy of my flight itinerary back to the UK.

To take this topic a bit further. Can my fiancee visit once again (90 day visitor visa) between sending the i129f form and the interview in Germany?

Yeah you can send it, she can stay here for as long as she does NOT overstay the VWP, so she could be here for 90 days into the process.
