Can you do a K-1 if you perform a nikah not registered through a court?

That could be a red-flag. Better to just have a fancy engagement-party in a hotel (with the word "Engagement" or "Betrothal" in prominent display).

If I go to Pakistan and do a nikah but not through court is it okay to file a K1 instead of a CR1?

That's a very very bad idea. Applying for a K1 after a nikah has taken place (whether or not it's registered) is totally against the rules. If you get caught or if they suspect you're already married during your K1 interview they'll reject you and force you to withdraw your petition. This happened to someone in India just for having a "marriage" ceremony that wasn't recognised by Indian law.

This happened to someone in India just for having a "marriage" ceremony that wasn't recognised by Indian law...
...and almost happened to us as well. I had asked Joe Uncle (Joshua Daniel) if an unregistered wedding could be done, and I could then file a K-1 and register the wedding in US (Joe Uncle HAS seen the reverse--people doing a civil marriage with later Christian one--many times), and he nixed it saying "no, we must be transparent with the law".

I don't know about Muslim marriage law in India, but if two Hindus in India have a Hindu marriage ceremony and do not "register", they are still considered married. If Muslim law in India or Pakistan is anything like that, then this is probably a no-no.
