On the other side of the issue, do you think it's ok for establishments like bars and restaurants to use physical appearance (not tidiness, but body shape, hair color, etc.) to choose employees? Obviously it's illegal; obviously it's also in practice at thousands of establishments.

It's not obvious to me.

All these restrictions seem fine unless you're not pretty with big boobs or lacking in intelligence. How is someone without either supposed to muddle their way through the world.

I work in TK Maxx, I guess that answers my own question :lol:

Strippers don't, but that's because they are independent contractors and can't. I can't think of any other profession like waitresses who can file for discrimination, but who are also often hired on looks.

This article may answer some of your questions.

Any business in the service industry feels a certain amount of pressure to hire the most attractive employees to represent their public "face." While it might not seem fair to hire or reject people based on their attractiveness, it's not generally illegal. Being a plain Jane or Joe is not federally protected. What makes appearance standards illegal is when they are based on protected characteristics, such as age, race, and gender.

Take the "all-American" image. Does it evoke a picture of a blond-haired, blue-eyed individual? If so, you could find yourself face-to-face with charges of race discrimination. Abercrombie & Fitch was accused of hiring mostly white men to be "brand representatives"; those who didn't fit that look (i.e., ethnic minorities and women) were not hired or else were relegated to backroom jobs. Last year, the store agreed to settle claims of race and sex discrimination for $50 million.

Appearance standards not based on immutable characteristics associated with a protected characteristic will likely stand up in court. Harrah's Casino implemented a "Personal Best" program in order to improve the company's public image. All employees were required to "be well groomed, appealing to the eye, and be firm and body toned." Specifically, female employees were required to style their hair, wear makeup, and polish their nails. Male employees could not have long hair, wear makeup, or wear colored nail polish. A female bartender was fired for refusing to wear makeup, and she sued for sex discrimination, but lost. A court ruled that the policy imposed equal burdens on both sexes.

The same reasoning would likely apply to the Borgata Hotel Casino & Spa's weight policy, which has recently drawn criticism for being biased against women. The casino started weighing its so-called "Borgata Babes" (cocktail servers) and bartenders for baseline numbers in mid-February. Anyone who gains more than 7% of their body weight faces termination if they don't lose the weight within a 90-day unpaid suspension. Most of the employees affected are women, but they would be hard-pressed to assert a sex discrimination claim since male employees are held to the same standard.

Interestingly, the first legal shot was fired by a man. Weight discrimination claims don't stand much of a chance, either, though, unless morbid obesity or medical conditions are involved. And the Borgata is not located in one of the few areas that have appearance discrimination laws (Santa Cruz and San Francisco, CA; Michigan; Washington, DC).

In general, employers have the right to impose appearance standards, as long as:

there is a legitimate business need (e.g., maintaining the company's image);

it is not based on an immutable characteristic (e.g., skin color); and

employees are equally burdened.

The U.S. Equal Employment Opportunity Commission filed the lawsuit Wednesday in U.S. District Court for the Eastern District of Washington.

The lawsuit contends the owner of the Starlight Lounge failed to promote waitress Angela Harper to a cocktail server position because of race and religion.

Race and religious discrimination is a violation of the Civil Rights Act of 1964, the EEOC said. The agency filed the lawsuit only after first attempting to reach a settlement with Morgan.

"It is disturbing to know that in today's workplace, there are still those employers who place more value on people's skin color or religion than in their capacity as loyal and hardworking employees," said Joan Ehrlich, district director of the EEOC in San Francisco.

Okay so let me get this straight--a black muslim and I assume US Citizen cannot get a job serving mixed alcoholic drinks and probably dressed in a Cocktail dress. (Which that word "cocktail" has a connotation all its own). Anyway so then doing an act that is contrary to her religious values she wants to seek damages from her employer for the Violation of her Civil Rights!

So who does this non-hot, non-white girl get to preserve her Civil Rights? The Federal Government!!! Oh my God! Who is the largest violator of Muslims, Foreigners, People of Color, and US Citizens who travel, have contact with people overseas, conduct financial transactions and commerce, or use the Internet, postal service, or telephone. Man Get a CLUE! IMBRA, Patriot Act, Wholesale treating of Americans like they are all Criminals in our nations airports, and Warrantless wiring taping of US Citizens by the NSA, oh wait no the owner of some whole in the wall culdesac in nowhere USA is a far bigger violator of the Civil Rights of the US Citizens, especially those of Minority status in race or religion. Give me a ###### break!
