Harper, who wears a headscarf in observance of her Muslim faith, sought the more lucrative cocktail server position, but the owner said she was looking only for "hot, white girls" to be cocktail servers, the EEOC said.

I'd feel funny ordering drinks from someone who is clearly an observant muslim.

having someone in a headdress serving booze would be a killjoy for me...kinda like being served by Mother Theresa or summat.

In the same way that intelligence can be a job requirement. Both are genetic factors.

If you had an IQ of 40 and applied for a job as a research analyst, would you sue the

company for not hiring you because of your "disability"?

Well, there are ways to filter out the unqualified. Few dumb people have a degree, so you can automatically weed them out that way.

I think it's wrong not to hire her because of her religion (Muslim).

The article said she was black. So she is a black muslim...Nation of Islam or something along those lines.

Strippers don't, but that's because they are independent contractors and can't. I can't think of any other profession like waitresses who can file for discrimination, but who are also often hired on looks.

This article may answer some of your questions.

Any business in the service industry feels a certain amount of pressure to hire the most attractive employees to represent their public "face." While it might not seem fair to hire or reject people based on their attractiveness, it's not generally illegal. Being a plain Jane or Joe is not federally protected. What makes appearance standards illegal is when they are based on protected characteristics, such as age, race, and gender.

Take the "all-American" image. Does it evoke a picture of a blond-haired, blue-eyed individual? If so, you could find yourself face-to-face with charges of race discrimination. Abercrombie & Fitch was accused of hiring mostly white men to be "brand representatives"; those who didn't fit that look (i.e., ethnic minorities and women) were not hired or else were relegated to backroom jobs. Last year, the store agreed to settle claims of race and sex discrimination for $50 million.

Appearance standards not based on immutable characteristics associated with a protected characteristic will likely stand up in court. Harrah's Casino implemented a "Personal Best" program in order to improve the company's public image. All employees were required to "be well groomed, appealing to the eye, and be firm and body toned." Specifically, female employees were required to style their hair, wear makeup, and polish their nails. Male employees could not have long hair, wear makeup, or wear colored nail polish. A female bartender was fired for refusing to wear makeup, and she sued for sex discrimination, but lost. A court ruled that the policy imposed equal burdens on both sexes.

The same reasoning would likely apply to the Borgata Hotel Casino & Spa's weight policy, which has recently drawn criticism for being biased against women. The casino started weighing its so-called "Borgata Babes" (cocktail servers) and bartenders for baseline numbers in mid-February. Anyone who gains more than 7% of their body weight faces termination if they don't lose the weight within a 90-day unpaid suspension. Most of the employees affected are women, but they would be hard-pressed to assert a sex discrimination claim since male employees are held to the same standard.

Interestingly, the first legal shot was fired by a man. Weight discrimination claims don't stand much of a chance, either, though, unless morbid obesity or medical conditions are involved. And the Borgata is not located in one of the few areas that have appearance discrimination laws (Santa Cruz and San Francisco, CA; Michigan; Washington, DC).

In general, employers have the right to impose appearance standards, as long as:

there is a legitimate business need (e.g., maintaining the company's image);

it is not based on an immutable characteristic (e.g., skin color); and

employees are equally burdened.

Does Islam say that you not only can't drink alcohol but also can't SERVE alcohol?

Muslims can't serve, sell, make, distribute, tansport or consume alcohol.

I never noticed that in the bars in Bahrain and the UAE. I got drunk with many a muslim.

Indeed. Let's say, for argument's sake, that the dumb person in question has a degree,

so technically he qualifies but still is as dim as a 3-watt light bulb in the fog. Is it legal

not to hire him because he's a dimwit?

Wouldn't you agree that beauty *is* a job requirement for a model?

I can also give you a few examples when it's perfectly legal to refuse employment on

the grounds of sex, race, skin colour or age.

On the other side of the issue, do you think it's ok for establishments like bars and restaurants to use physical appearance (not tidiness, but body shape, hair color, etc.) to choose employees? Obviously it's illegal; obviously it's also in practice at thousands of establishments.

I believe there was a case involving the restaurant, Hooter's, over this issue.
