just want to know if the immigration in manila will ask about consent from the father since my son is travelling with me and his using his father's surname..and im just worried since our flight is end of this month i dont want to have a problem during departure..

ok, quick questions... is your son moving with you? in that case did you do a k-2 for him? In which case NO..but if is it just a visit? You will want to get a letter stating that said child is able to visit from 09/10/10-10/10/10. They make not ask for it but better safe then sorry

yes my son is going with me on a k2 visa..his father is on his birth certificate...

The real question is: Were you married to his father or not?

Look at the links in my signature...

Per Philippine Family Code unless the parents were married at the time of birth the bio-logical father has no parental rights unless he sought and was given specific rights in court.

the links referred to illegitimate children...

are children considered illegitimate only born out of wedlock or does the father being named chnage that in the law there?

here in the USA that's why men WANT their name on BC, even if not married, because it gives them rights to the child (as well as responsibilities until the child reaches 18 or older in some cases).

soemthing to check would be if Phillipines is part of Hague Convention... if so i wouldnt take any chnaces, get a letter from the father if you dont have a court order.

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

In the Philippines all that matters is if the parents where married when the child was born, just listing him on the birth certificate doesn't give the father any legal rights.

My step-son has his father listed on the BC and it did not matter.

Also Hague Convention doesn't apply to Philippines.

@bob and anna..nope where not married..his fathers name is on the birth certificate and his using his father surname but we end our relationship after 2 yrs when i gave birth..till now i dont know where he is..last time i know is his with someone else and his having a baby again now..he know that im getting married and i guess he already know that were moving to US..by the way when you step son travel there is there any issue that they incounter inthe immigration?

CAN A TRAVEL CLEARANCE BE ISSUED TO ILLEGITIMATE CHILDREN WHO ARE STILL APPLYING FOR THEIR VISA IN THE EMBASSY?

Illegitimate children are under the custody of the mother. If they will be traveling with the mother, they are not required to secure a travel clearance from the DSWD. If they are traveling with person other than the mother, they must secure a travel clearance.

is this info enough and i should not worried about getting a consent...?

Hi Virgo22,

You might want to check with DSWD(Department of Social Welfare and Development) as far as I know the child needs travel clearance from them if the child is only traveling with one parent. Good luck!

We had no problems at all. If the USEM asks tell them you were never married and remind them that your CENOMAR supports that fact. You can print the info from the link in my signature and have it in hand just incase on your interview day but the IO/CO at USEM should know the local laws regarding this.

You will not need travel clearance from DSWD.

Hi

You have to see it based on philipines law. No matter if he travel with a k2 visa or whatever, this is only valid in USA not necesarilly in Phillipines

I strongly recommend you to visit the airpot authirity in Phillipine to see the requeriments

Commonly in many conutries your are not allowed to travel with kids, without a notarized and registered document where the parent that is not travelling allow the kid to do that with someone else, even if one of their legal parent is travelling with the kid. Ifnyou cannot find the parent you should go the court and let them to give you the permition
