Question about affidavit of support

Ok, for the Affidavit of Support--I know that you have to meet or exceed 125% of the poverty line, and I also believe that you have to send in tax transcripts for the last 3 years. Do you have to have met the minimum income (or assets) FOR the last three years? I met it for 2009, and I will for 2010...but I didn't for 2008. Will that be a problem?

IMO Nope. You progressively make sufficient income to overcome the poverty lines.

Thanks--that's what I'm thinking (and hoping!) too. I don't really want to consider a co-sponsor at this time, as my family is not really supportive, and I feel like that's asking a lot of a friend (although I will if I have to!). Hopefully it won't come to that!

Any other opinions/experiences/affirmations are appreciated!

From what you say regarding your income it appears to be ok. Current and continuing income is what's important. As Loto stated your history shows a growth in income, that's always good. :thumbs:

i think you only have to be above it at the time that you are petitioning the spouse.

3 years is just to show that you are stable and have been above it for 3 years.

if you haven't been, then you don't have to show 3 years.

Correct, and also incorrect. The current year's income is what will be looked at. As long as you meet the poverty level at the time the I-864/I-134 is signed, you will be fine. However, USCIS requires most recent plus 3 years tax returns or transcripts, whether you met the poverty level, or not.
