Hello,

This is almost my first post. Just as an introduction, I am Egyptian, married to a USC for seven years, lived together abroad the whole time. Came here on a visit in April and decided to stay in June. We filed in August for AOS. So just after we received the NOA1, we got a RFE for my husband's tax forms which we didn't send because he didn't file taxes while he was abroad. We sent with the package a statement saying his income was non-US taxable income. So two questions here:

First: Only our lawyer received the RFE on Friday. Would they send a copy to us as well?

FYI we have a co-sponsor and we sent his tax forms.

Second: any experience with the non-taxable income issue? The lawyer recommends we send the same statement again, saying he didn't file because he had no US taxable income? Would this be sufficient? I am not second guessing the lawyer but just wondering if someone has a similar experience.

Hello Ranio,

I am not too sure about non-taxable income, but I do believe that if you do not do taxes on previous years, you are suppose to include a letter stating why you did not file taxes. I know that you are suppose to do a I-864 form on yourself even if you do have a co-sponsor.

Thanks for your reply. My husband did file the I-864 and sent a letter along. Our only assumption now is they missed the letter. It's frustrating because I know everything will be on hold until this is sorted out.
