I´m here again. i submit I-601 (overstay)on April 2010, i still waiting, but i have a question?..if my waiver is approved, i need to submit petition for our son 4 years?, thanks.. Note: he was born in my country and my husband cann´t come to here for registration abroad. My husband lives with my oldest son. My visa IR1 can derives to my baby (IR2)??? or i need apply for him?.

The USC would submit an I-130 petition.

Is possible to ask for an expedite, and get it, on initial filing..

The USC would submit an I-130 petition.

Thanks for your response, but if my husband USC submit another I-130??? we have to wait the long time of tramit?? or Can my husband submit a form I-824, Application for Action on an Approved Application or Petition????

ok - as I understand yer casefile (from studying yer timeline)

this is the biological son of you and your USC spouse.

Yer USC Spouse can't get to Peru to 'authenticate' or 'sign' a birth certificate, so any concept of 'consulate record of birth abroad' just won't work for you two. That's a sad reality, alas, but IF a CRBA is available for you two, it's much less hassle, much less time than the other option -

is to file yet another I-130 for the child.

Now, since you, the mother, already have an approved I-130 in place, your USC spouse can ask for, and get, an EXPEDITE on the I-130 that he'd be filing for the child. It's a bit involved, see http://www.visajourney.com/forums/topic/255138-k3-k4-visa-converted-to-cr-1-by-national-visa-center/page__p__3918125#entry3918125 and ignore the bits about NVC EP, as your husband won't qualify.
