My dad is the person who is going to be my wifes co-sponser when we file for our aos, he did this before when we filed for our k-1 visa. Apparently he is working under a new supervisor now and his company is refusing to give a letter of employment stating its against company policy. They said if he wants it then they need to see a statement from whoever needs to see the letter. Any suggestions would be greatly appreciated. Thanks.

This is absurd!! Did he try going straight to human resources/personnel? They're the ones that usually do this sort of thing, not the supervisor/manager. Perhaps they'll be more helpful. Good luck!

May 2nd - Sent I-129F to Vermont

May 13th - NOA1

June 23rd - recieved RFE (IMBRA)

June 24th - Sent back RFE

June 27th - 7 touches

June 30th - touched

July 3rd - touched

July 10th - NOA2 notice via email

July 14th - NOA2 via snail mail

July 14th - petition mailed thru DHL to Asuncion, PY

Week of July 17th - Embassy received my petition

July 24th - beneficiary receives packet 3

July 27th - medical exam

Aug 7th - interview - approved :)

Aug 11th - picked up his visa

Aug 21st - purchased plane ticket!

Aug 30th - reunion day :)

From what I understand you guys dont HAVE to submit a letter from the employes, and if you dont I guess you can work on the issue if INS gets back to you after viewing your papers and IF they then request this. I guess another way to approach it is to show your employer the form where INS is asking for the employe letter, in there it is, the statement that his boss wants...

Tell him to write up the statement ( Below example) take it to HR and ask them to sign & verify the informatioin

Company he works for

His current position/ Title

Hire Date

Aprox # of hours he works on average

Salary or Hourly pay rate

Signed by HR or immeidate supervisor

printed if possible on Company letter or include Business card of supervisor or HR personel

If they refuse have him take I-864 instructions and show them where and why he needs it.

His paystubs ( recent months) and W'2 will work also have him obtain a statement of his bank account.

In line with neptune's post, who is speaking for "his company" when refusing to give a letter? Perhaps they are concerned about creating an employment contract by writing such a letter, a typical and reasonable concern these days.

Try showing them the I-864 form and instructions as the reference for why you are asking for the letter.

Thats true with I-864EZ although submitting a letter with the form is not required

having the employment letter or additional evidence of support available at the Interview helps.

They often ask for things like that especially in cases of a co-sponsor.
