Is the I-129f needed???

Im american military in afghanistan and my wife is filipino living in the philippines. We were married in the philippines in feb. 2010 and we want to get her visa issued by the time i leave afghanistan so she can come straight to the states. Im so confused about this whole k-3 visa process... Do i need to submit both the I-130 and the I-129f? Because from what it sounds like is that the I-130 is for immigrants and the I-129f is for non-immigrants.. but everywere I look for instructions on what to do says that you you have to file both? Any help or past experience would be appreciated..

We started our K3 process last year, we submitted both our I-130 and The I-129f... Our I-130 petition was approved when the I-129f petition was still pending. When this happens you automatically go from the K3 route to the IR-1 CR-1 route.

And it says in your detalis that you are filing for IR-1 CR-1 not the K3. So for this visa you do not have to submit the

I-129f. Read the guides for the IR-1,CR-1...

05/25/2010 Sent of AOS and DS-230 to NVC

06/16/2010 Recieved checklist from NVC about birthcerteficate,marriage cert.

06/17/2010 Sent package of to NVC

06/28/2010 PAckage recieved at NVC

08/08/2010 6 weeks and still waiting for news...

08/10/2010 SIF at 06.39 am

08/09/2010 Case completed at NVC !!!!!

08/12/2010 Interview date assigned

O8/19/2010 Medical 1st appointment

08/26/2010 Medical 2nd appointment passed!!!

09/07/2010 Interview Brussels Embassy at 2pm!!!!!!! VISA APPROVED!!!!!

09/18/2010 Our daughters 1st birthday: without daddy :((((

09/21/2010 POE ALASKA FINALLYYYYYY!!!!!!!!

12/31/2010 Second anniversary

We started our K3 process last year, we submitted both our I-130 and The I-129f... Our I-130 petition was approved when the I-129f petition was still pending. When this happens you automatically go from the K3 route to the IR-1 CR-1 route.

And it says in your detalis that you are filing for IR-1 CR-1 not the K3. So for this visa you do not have to submit the

And look into expediting your petition - because you are active duty AND deployed you should certainly meet the qualifications (we did). It helps to speed everything up quite nicely.

I've been on your profile and I noticed something...What is DS-3032 / I-864 Bill? What is it for and where will I get that? plus how much did u pay for it?

And look into expediting your petition - because you are active duty AND deployed you should certainly meet the qualifications (we did). It helps to speed everything up quite nicely.

Form DS-3032 is used by the applicant to nominate an "agent" to assist with their application and to specify a mailing address to be used by the NVC (National Visa Center). The "agent" may be the one who filed the immigrant visa petition, an attorney, friend, or non-governmental or community-based organization. The agent cannot sign documents for the applicant, but can assist with fee payments and document collection.

I-864 form is required for most family-based immigrants and some employment-based immigrants to show that they have adequate means of financial support and that they are not likely to become a public charge.

They are not used until you get to the NVC phase of your immigration journey.

I'd give up on the K-3, in it's entirety, and focus more on the CR-1/IR-1 visa types, if I were in yer shoes.

Military expedites are generally considered if the petitioner is active duty and deployed or about to be deployed. Generally you are required to show proof of deployment with a letter from your C/O or copy of your orders etc... This can bump you up in line. I have heard that the expedite needs to be requested at each stage of the immigration process. Meaning you will have to send in the papers to the nvc, whichever service center you are sent to, and the embassy your beneficiary will be interviewing at. I don't know all of the details about it but it definitely warrants further research as i'm sure you're eligible.

He needs to put the petition together and then send the petition, when the check is cashed and you get your case number you call the military hotline on the USCIS website and request an expedite based on him being deployed ( if he calls hes more likely to get answers quicker since hes the military guy, that happend when my husband called ) when he calls or you call and request it they will send you some papers asking for the orders and proof, once you send that they will work on it and grant the expedite or not. Its up to their disgretion but since he is deployed they may give you it.

We applied for expedite when my husband was soon going to deploy and our case was approved in 5 days from getting the noa1.

Tater another VJ member applied for expedite while her husband was deployed but they didnt give them one.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Hi !

When I-130 IS filed , include 'expedite request' in cover letter, attached to the TOP of the I-130 petition. Is not any form, simply a cover letter. Outside of the envelope, in big red letters, write 'CR-1 EXPEDITE - DEPLOYED MILITARY' on the outside.

When the I-130 petition is approved, it'll travel over to NVC.

Once NVC has it, you'll need to get in touch with supervisor Pl Sue, ask again for a military expedite and then

you (you and yer husband) to sling over a DS-3032, an I-864, and a DS-230 , with additional documents.

Dont worry about the I-129f(k-3 visa), just file the I-130.

Ahh ok...so it means that he (my military husband) is the one who should be able to apply the expedite visa so it would be approved.Thank you for the info!no0pb.gif

actually, a military expedite CAN BE 'asked for' with the I-130 submittal, in writing.

Usually, a cover letter, requesting the expedite, referencing the deployment, is sufficient, whilst 'adding on' a copy of the deployment orders and a letter from the 'first shirt' or first sargeant...

if you do it 'at the beginning', ie - initial submittal (in writing, via a cover letter and outside special labelling) - it gets into a different queue altogether, for even more speed.
