Husband working abroad, bringing us.

I'm caught in between but not really?

I'm here in the US with a conditional permanent resident visa. My removal of condition should be made sometime around February but my husband accepted a job offer in Australia. Husband is American Citizen. We have a child together and he is bringing us with him to Australia. I am not sure what to do with my US status. My husband said that he has no problem me continuing the processing of the resident visa but to stay in this country without him (he has no family in this state, his parents already passed away, and I don't have family in the country, too.) doesn't sound wise -- insurance in case any of us is sent to the doctor or hospital, etc., plus we will be apart.

My question is, can I still apply for the removal of condition even when I won't be staying here but will only be here for that sake (filing the paper)? Should I just voluntarily give up my resident right? Or is there a way to tell our situation to USCIS and ask what we can do about this -- say for example let us file everything in Australia? I know the last part sounds silly but I'm really in limbo and don't know what to do.

Any idea? Suggestions? Advise?

How long do you plan on being in Australia? If it is less than two years, I'd try for staying in the US, removing conditions, then joining him after applying for a re-entry permit. If you guys are planning on being abroad for more than 2 years, I'd give up on the greencard now, then apply for a fresh spousal visa via DCF when you want to return.

PS: if he is going over on a government or military contract, you may be able to remove conditions from there.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks a lot! We'll only be there for 2 years. Well, that's what his contract is saying but could be extended who knows. While waiting for people to reply, I just decided to stay for lifting of conditions purposes and be with him in between period. My husband is agreable on it, I just hope it works and the USCIS will not give a fuss about it, you know.
