Hello, I am new to this forum. I just need some help. Hopefully, someone on this forum can help guide me in the proper direction.

I just got court marriage in Manhattan, NY this past week. We have been dating for a year.

1. I am a naturalized US Citizen, never married before

2. My wife is a canadian citizen, never married before. Currently on a student visa that is NOT expired.

I was wondering if anyone know how long this process would be for her to get permanent status?

Would I file the I-485 first and then file for the I-130 ? or would I apply for both of them?

Any additional forms I would need?

Finally, Should I just hire a lawyer for this? or would I be able to do this myself? If by lawyer, how much do they cost usually?

Thank you!

Darren

Well Darren, It really depends on where you live. Some offices process faster than others. We live in California so just to get an idea look at our timeline. Of course we had an RFE and took a month to submit it, but most people seem to have similar timelines. Good Luck.

Hey Darren,

First of all, Congrats! You should definitely check the guides that "Krautlaus" mentioned in his post and you should file both I-130 and I-485 at the same time...

As "SaraDee" said, how long it takes depends of the office that will be responsible for your case. The USCIS website gives you a pretty good estimate of the "Processing times" of each of its offices... You should check it out!

Yes, you'll need a few additional forms (G-325A, I-864, etc) --- it's all explained in the guide...

Most Adjustments of Status are done without the help of a lawyer; however, if you feel that you need one you should get one (at least have a consultation with one)... If there are not any problems that might affect your wife's AOS process, a lawyer might charge you anywhere from $1500 to $3000 (depending of the lawyer, his/her experience, etc)... If there are problems the price might increase...

Hope this helps... Good luck and, again, Congratulations!!!
