I went to the USCIS website awhile ago to check my case status and my wife was approved but step child is still in the intial review process. No emails or text messages like before. They said the notice was mailed on Dec 29th. That would have been exactly 3 months since the petition was accepted. Hopefully everything goes well now.

Hi Tony, we are in the same position, wifes went through no problem, but step daughter had a RFE dated Dec 2nd still hasnt shown up in the mail, had to request again, and find out what was missing, the need her birth certificate!! not required when submitting go figure, hope you hear some good news soon

our I-130 approved on the 4th...

good luck everyone else...seems september comes before july at CSC

awesome news huge congrats Truebrit, hopefully NVC will be plain sailing, I didnt realise I need certified copies of everything so having to get copies of police certificates arghhh

hmm...

ididnt realise that neither...ive just sent off for mine, lol...

im just going to make a copy of it when it comes back and give them the original...it all goes in the secret envelope anyways (i think)

ill keep the copy, if they then ask for yet another one...ill ask the ARCO for another...and pay a fiver then...if it comes to it...

im not panicking...lol

2004 - we met online.

7th May 2007 - filed I-129 paperwork

9th June 2007 - received I-797 notice of action

13th November 2007 - I-129 approved

18th December 2007 Visa and medical interview

12th January 2008- Shipping company arrived

14th January 2008 - landed at Newark Airport.

9th March 2008 - got married(received SSI number)

April 2008 - My things arrived in USA from the UK

9th March 2009 - our 1st Anniversary

14th June 2009 - returned to the UK

9th March 2010 - our 2nd Anniversary - spent apart - so lonely :(

1st September 2010 - filed I-130 (applying for IR1)

11th Sept - Received I-797c address part C error

13th Sept - Resubmitted I-130

24th Sept 2010 received second I-797 NOA status - "initial review"

4th January 2011 - I-130 Approved - moving to NVC!

12th January 2011 - I-130 forwarded to NVC.

31st January 2011 - Notification of LDN number received in the post.

I submitted the childs birth certificate in the petition, hopefully I dont have to wait the full 5 months until its approved.

You always need to submit the BC with a I-130 for all parties involved, if you dont have one you can use your passport for the petitioner but any intending immigrants need a BC. On a K-1 visa, the I-129f petition you dont need to submit any BC for the intending immigrants.

Unless there has been a recent change the beneficiaries birth certificate is NOT needed for the I-130 petition. It is, however, required at the NVC stage.

When your going to submit papers to bring someone's kids into the US , it will be wise to just include everything right from the start. I been thru this 3 times in my lifetime, dealing with immigration and stepchildren. I never had an RFE. I learned sometimes even what's written and what some person doing the processing of your case wants can be 2 different things. If the person doing your case wants to be maticulous, they can give you an RFE for almost anything wheather its written or not. In the case of the I-130 it states on page 3 of the instructions #8

8. Stepparent/Stepchild: If your petition is based on a stepparent-stepchild relationship, you must file your petition with a copy of the marriage certificate of the stepparent to the child's natural parent showing that the marriage occurred before the child's 18th birthday, copies of documents showing that any prior marriages were legally terminated and a copy of the stepchild's birth certificate.

I will bet you my house now that if you send just the kid's BC and not the parent's , that you will get an RFE even though it doesn't say to send the mother or father's BC.

Now on a I-129f for the K visas, you don't need to submit the child's or children's BC's . When a I-129f is approved, USCIS sends the case to NVC but NVC turns around and forwards the case to the US Embassy that will do the interview. NVC doesn't process anything, its all done at the Embassy.

Sorry for the confusion. I was referring to stand alone petitions, not those involving children. Thanks for the clarification. :)

The office of the congressman called Matt back today like they promised. We were really pleased by their "quickness". Matt called this morning and he received the call back in the afternoon. He talked to the immigration specialist of the congresswoman and this specialist called the USCIS VSC to inquire more about our petition. So girls, the reason it was not "touched" at all was because we sent 129-F after two weeks we sent the I-130 (spouse visa). They took the I-130 and attached it to 129-F and put it on September filers. WHAAAAATTTTT??? Now that explains everything while everyone was getting approvals on my batches and I'm left ALONE!!! So, the immigration specialist requested our case to be expedited. BIG YAY! :D And that she will keep an eye of it. Another BIG YAY!!! :D We should be hearing in 2-3 weeks. o_O But that's just an estimate. As soon as they pull our papers into the cabinet of petitions (lol), they will work on it. Girls, who would not be pleased with the congresswoman's office? At least now, we have a clue on what's going on. What a relief!!!

Just wondering why they would tell you a police certificate from Hong Kong is NOT required if she resided there for two years?
