Need help to get USCIS Moving

Hello All,

I am an RN in Las Vegas Nevada who used to feel that I would never find a partner in life. That has all changed since I met my fiancee Kezia. I am not naive, I know there are those taking advantage of others out there. Kezia is not one of them. We Skype everyday, usually for at least an hour talking about everything from politics to cooking recipes. She has helped me and my mom through my Dad's passing last month and is helping my mom with tackling an aggressive cancer. She is a part of my life and I hers.

We have been very patient waiting for USCIS to process our I-129F (K1 Visa), but NOTHING follows what they say on the site. 6 weeks now and no NOA form received! Spoke with two officers and both said everything was fine. My mom would very much like to see us get married in person...and I should last for 5-6 months, but her chances are poor to last a year +. She has Leiomyosarcoma a very rare form of cancer.

Given how things are going at the very beginning of the I-129F process. It seems very possible that USCIS will continue to drag their feet until my mom passes. If anyone knows how to get USCIS moving PLEASE LET ME KNOW!

Was your check ever cashed? Since you seem to have an urgent case maybe it would be best to get married and then file for a spousal visa, that way your mom can definitely be present at the wedding.

I'm confused.

Your check was cashed and you got your case # from USCIS but they're saying that your NOA1 was undeliverable and is being held for 180 days? Is that right? Did you call that number you listed in your timeline? I have heard of cases where the NOA1 gets lost in the mail. You can have them send you a new one but it'll cost you. I can't remember how much but perhaps you could call and ask them. I know that you need your NOA2 for certain for your interview but does anyone know if you ever actually need your NOA1? I'm not 100% sure but it seems like as long as you have your case # that's all you need. Don't trust the website. Just because it says that your status has not been updated doesn't mean anything. Tons of VJ members go their entire journey without their case being updated on the USCIS website. Plenty of people have already had their visas issued and yet, if you log into the USCIS website to check their status it still says initial review. So definitely don't put too much stock in the website. If you have a case # and the people on the phone said that you're fine, unfortunately there isn't really anything else you can do now but wait. If you find your case falling outside of the normal processing times, that's when you can finally get in touch with your senator.

Good day..i don't know if I'm correct(but if I'm wrong, anyone can correct me)...since you mentioned about your mother's case, instead of having a second visit to the Philippines, why not let her visit you on a tourist visa while waiting for your K1 visa process..if only you haven't filed for a K1,(I don't know if it's legal but there were some who have done this..),she can visit you on a tourist visa then marry there..but ofcourse, she needs to come back to Phil when after 6 months then maybe you can file for her a spousal visa(at least, your mother can still witness the wedding and might be the US embassy would not see it as a ground for violation since you will be doing that prior to your mom's case)...but on the other hand, since you have applied for K1 already and still waiting on the process,,she might still be able to come there to US through a Tourist visa but you can't marry..just her going there for a visit to know your mom and relatives in person(or lese if you marry her while on K1 processing, she might be deined whenever her interview comes for her K1 visa)....btw, sorry to hear about your mom...about your K1 petition, just try and try to inquire about it @ USCIS...have faith..with God,everything is possible...God bless!!

Unless his fiance has LOTS of assets and dough it's almost IMPOSSIBLE for the average filipino to get a tourist visa to the US. To many have gone TNT. [Went illegal when arriving in the US.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Thanks for all the responses!

The check was cashed, and we keep on calling them. David's even got an appointment with his local office at Vegas on Sept 15th. He says that even though they are not the one's processing our papers, he hopes that they've got the direct numbers or emails of the CSC and maybe the officer who is handling our case, so they can send them an email or give them a call in our behalf. If that doesn't work, and we don't get our NOA1 yet, he says he'll call his Senator then.

David's trying his best to get results and to get me there soon. Her Mom is excited and it's good for now because our wedding is giving her something to look forward to, although it could also make her complacent that she can go soon because her youngest son will soon be settled.

We can't get married here or there, because it will just make things worse for our application. What we can do is have our engagement party here, and try our best to be there as soon as possible and get married there, hopefully before February.

I just hope that our application is indeed going forward and will be approved soon. When I see the VSC applicants getting their NOA2s within a month, I feel really really envious, and hoping that it's us, and that I could go join David this November. I'm also hoping that my interview will be in time for his visit, so he could be with me and show his support at the US Embassy, maybe on the morning of the 26th of October, just before his flight home.

More wishing and more hoping, and more praying...

We finally got our NOA1 in the mail, dated September 1, and it's now September 7.

We submitted our application on July 19, so it took them 43 long days just to give us our NOA1 :crying:

Our application hasn't been touched, not even once, after the NOA1 :(

I'm worried about my David.

He's already getting depressed, and a few days ago he just snapped from all the stress lately that he just went paranoid on me and we had a big tiff (probably because I also just couldn't be patient anymore, and I was PMS-sing).

He's got a trip scheduled here this Oct 23rd, which will be our official engagement party and where he will meet the rest of my clan (extended family) and my friends, but he'll only be here for less than 4 days, because he can't take a break from a job that he just started more than a week ago. Also, the 5-6 weeks wait seems to be too long for both of us, especially for him.

His Dad has been sick for months and was in ICU for a time, and finally passed around the end of July, but not without a lot of trouble and stress with some troublesome hospital staff who only wanted money or cared more for the body than for the mind.

His Mom has also had cancer for more than a year, and has been going through a difficult time with chemotherapy, losing his partner, selling his house, and moving to Vegas to be closer to David.

David has also been promoted several times to a job that he didn't want and was too stressful for him, although he finally got a job now (though it's a demotion) that he likes. He's practically started 3 jobs and left 3 jobs within the 9 months that we've known each other, and it's a lot of stress learning new things and changing a lot of things that his predecessor didn't do (and do a great job that's why they keep on promoting him), and he's also moved to be closer to work and to the city where his Mom gets her treatment. He also had to drive to his Mom 5 hours away almost every weekend, to attend to his parents and now just his Mom, to help them out. On top of that, I've also been having sick here in Manila, on and off, mostly accidents or infections, and my insomnia has just gotten worse (and causing my immunity to just go worse) and it's causing him a lot of stress also.

All that stress was just too much for him, and I think it just finally hit him a few days ago that his Mom is really dying and no matter how many chemotherapy she's going to have, he will lose him soon, that he just snapped. I tried to be there for him, as much as possible, by talking to him twice a day, being his sounding board, trying to comfort him and distract him as much as I could, even if I am personally not feeling well, and I even offered to be the one to go with his Mom and take care of her for a month at this cancer facility in Guangzhou in China if she wants to go, but it just wasn't enough. He really needs me, needs my calming and reassuring presence, my comforting touch. I'm so sorry for him.

I am hoping that our case will be processed soon, so I can finally be there for him, to help him out everyday, and to support him with his Mom and all the things that he's been going through. We also miss each other so much that it's a real agony for us.

We are going to call USCIS tonight, hoping that we could qualify for expedited processing. I mean, if others can get approved in 23 days, why can't our case move any quicker? Do we have to wait until David's Mom also dies, and he will not only feel really really alone, but for real this time, and I wouldn't be there to support him? I sure hope that they will act on this sooner, and not later, as this accumulated stress is proving to be too much for both of us. For now, it's taking a toll on him more mentally and me more on the physical, but it may not always be the case, and he could also get physically sick... and what use would he be then to his Mom who needs him more, and what of his job?

If anyone here knows something that can help, please let us know.

We finally got our NOA1 in the mail, dated September 1, and it's now September 7.

Dig in for the 'long march', alas.

USCIS/CSC has a posted 'turnaround' time of 5 months, 150 days.

Any USCIS TeleOperator that ya talk to , these last 2 months, has said 'probably 6 months' or 180 days.

IF you get approved prior to 150 days, it's a blessing.

If it's more than 180 days, is time to have an official freak out, engage the Immigration Liason Staffer with yer local US REP or US Senator's office.

We've got some very good news just before his trip to the Philippines. :dance::thumbs:

After all the trouble that we went through, and after all the issues that we've had in our respective families these past months to add to our stress, our expedite request was approved, :dance: and we also got an update on the website that I believe was the NOA2 already. They say that they mailed the approval yesterday, although I'm wondering because we got another "touch" the day after that.

Thanks to all your help and support! and many thanks to Officer Beltran for helping expedite our I-129F. :thumbs::dance:

So to all of you guys here who has a reason to be expedited, try it, because it works, especially for those in the military who will soon be assigned overseas.

For now, all I'm worrying about is David's trip to the Philippines, especially the short time between the ETA of the international flight and the ETD of the domestic flight. I pray that the superstorm wouldn't be too bad and will be out of the country way long before his flight, and I pray that his flight arrives so much earlier than the ETA and without glitches.

Thanks to everyone again, and I'll keep you posted. This has been a very good support group and I will continue to hang out here to help out others too.
