Couple of Questions on AOS

I am about to file for my wife's AOS and had a couple questions.

1. Marriage Certificate: WHAT SHOULD I SEND TO THEM? I have my marriage certificate from Pakistan where I married my wife will that work or I need to go an do a Court Marriage in the states.

2. G325A Petitioner: Do i need to send a G325 form of mine as well as my wife's (non-immigrant)?

3.Medical Examination: My wife had her medical examination October of last year back in pakistan, does she have to do an medical examination in the states or is it valid.

How long is the medical examination valid for?

4. I-601--What is this? do i need to fill this out?

5. Travel Documents: I-131- Do i need to fill this out? If so why?

If your marriage certificate is in English, it should be fine. But if it is in Urdu/Sindhi/foreign language, it would have to be translated into english. You don't need to do a court marriage.

2. G325A Petitioner: Do i need to send a G325 form of mine as well as my wife's (non-immigrant)?

Yes. Both of you need to send the G325A individually filled.

3.Medical Examination: My wife had her medical examination October of last year back in pakistan, does she have to do an medical examination in the states or is it valid.

How long is the medical examination valid for?

There is a list of immunizations required by USCIS. Look for it in another thread here. If you have done it in Pakistan, you would need the immunization records by the doctor. Also, you would surely be required to get the TB Test done.

4. I-601--What is this? do i need to fill this out?

For simple Adjustment of Status, you are not required to fill this form up.

5. Travel Documents: I-131- Do i need to fill this out? If so why?

Travel document means the Advance Parole. It is required for those who would want to visit their home country and be back in US while the AOS process is going on. If you leave the US while the process is going on without the travel document, you would not be allowed back in the country, and the AOS case would be deemed void.

As of June 30, 2010, the processing time for Adjustment of Status on the USCIS website is 4 months...however some of the VJ members have been experiencing delays up to 7 months.

02-23-2018: Sent N-400 Application online

02-23-2018: Date on NOA, retrieved from online account

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

The answers listed above to 2 and 3 are INCORRECT, 5 is slightly wrong

2. The petitioner is now irrelevant, the immigrant completes the paperwork as it is THEIR status being adjusted. A G-325A is only required by the immigrant. If the Op were filing an i-130 THEN the petitioner would be required to submit a G-325A, but not in this situation

3. A TB test IS NOT REQUIRED as long as your K3 medical is still valid as a TB test is part of the medical examination, not the vaccination transcription. It is ONLY required if a full examination is undertaken, not just a vaccination supplement

5. The AOS is considered ABANDONED if you leave the US without an AP document, not "void". Semantics but the two words mean different things.

Geez, do NOT do this under any circumstances. First, you're not eligible to marry again because you're already married. Second, the K3 requires that you were married at the time the petition was submitted. If you submit a marriage certificate dated after the immigrant arrived in the US with the visa then this will blow up on you BIG TIME.

Submit your Pakistan marriage certificate, along with a certified English translation.

No, just send one for her.

How long is the medical examination valid for?

I believe the medical examination is valid for one year, which means you're getting close to the expiration. The medical exam performed by the panel physician in Pakistan should still be valid, but USCIS is somewhat unpredictable about this. They do occasionally issue an RFE for a full medical even when a medical was performed abroad. For some inexplicable reason, they seem to either lose the medical results or somehow deem them to be inadequate.

At the very least, you should get her vaccinations transcribed to an I-693 by a civil surgeon in the US. If you'd like a little extra insurance against an RFE, you could repeat the medical as well. It would add $100 or more to the civil surgeon's fees, but it's relatively quick and easy - they draw a little blood, give a TB skin test, and a minute or so of poking and prodding by the physician. Most people seem to get by without having to repeat the medical. On the other hand, if you get an RFE then you'll have no choice but to get the medical.

4. I-601--What is this? do i need to fill this out?

An I-601 is an application for a waiver of inadmissibility. If your wife had an inadmissibility that required such a waiver then you would have been required to submit it and have it approved before she got her visa.

5. Travel Documents: I-131- Do i need to fill this out? If so why?

No, not with a K3. Read the form instructions. An I-131 is an application for a travel document that would allow an immigrant to leave and reenter the United States. A K3 does not need a travel document because the visa itself allows the immigrant to leave and reenter without abandoning their AOS application.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
