I just finished waiting for a long divorce to finish before filing I-129F for my financee to come here from the Philippines. After the judge signed the divorce papers, I had my fiancee sign and date her G-325A and letter of intent to marry me. She then mailed them to me so I could put them with my I-129F. However, it ended up taking over a month for the courts to file my divorce papers and give me access to a copy. Now it has been about 40 days since my fiancee signed and dated her G-325A and letter of intent. Are they too old to use now? Do I have to wait for her to send me more copies before I can file?

03-21-2010 - I proposed to her in the Philippines.
09-07-2010 - I-129F filed for K-1 Visa.
09-12-2010 - NOA1 confirmation email received.
11-02-2010 - I visitied the Philippines again.

02-07-2011 - NOA2 email recieved. Approved.
03-22-2011 - Case at USEM.

04-15-2011 - Interview Date. She passed.
05-01-2011 - POE

06-25-2011 - We were married.

-Life has been great ever since.

Shouldn't be an issue - they are good to go.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Shouldn't be an issue - they are good to go.

If they don't mind the date on her G-325A and letter of intent being about 40 days old, then I will go ahead and file the papers on Monday and begin the countdown. Does anyone else have an opinion to add? Thanks.

Maybe you won't be able to file your petition today 'cause it's Labor Day. What about tomorrow? :) It would be fun, my fiance's sending our petition tomorrow as well. Perfect timing. Let's see how our timeline will move. :)

Maybe you won't be able to file your petition today 'cause it's Labor Day. What about tomorrow? :) It would be fun, my fiance's sending our petition tomorrow as well. Perfect timing. Let's see how our timeline will move. :)

You are correct. Today is Labor Day, so I'll have to send the papers tomorrow. How exciting that your fiance will be filing the same day. I wish you both the best of luck.

By the way, I just noticed today the new I-129f and I-130 filing instuctions and filing location. It has changed in the last 3 months compared to the instructions released earlier in the year. It sounds like things may take longer if the new location is not used because it will have to be forwarded. Just figured I would mention it if your instructions are from earlier this year.
