just a wondering if the port of entry will ask any ducoments from my son aside from visa and passport?will they ask for custody paper or any ducoments that can proof that im allowed to bring my son in the US...the consulate did not ask anything from my son aside from passport and birthcertificate?

Yes. If your son is under the age of 18, you will need notarized form of permission from his father, or if the father is deceased, you will then need to show a death certificate.

They won't ask for anything at the Port of Entry except your passports and the sealed envelope. It's the Philippines that will clear you for exiting the country with your son.

At the NAIA, as you go through the immigration line, you will be escorted to a booth and asked to present proof that he is your son, and/or that your marriage to his father is annulled (if you were previously married to him). If you and the boy's father never married, you don't have to worry...DSWD clearly states that illegitimate minor children are allowed to travel overseas with their mothers without the father's consent. Have your son's birth certificate and/or annulment papers (if applicable) ready in your carry on bag.

If you and the boy's father never married, you don't have to worry...DSWD clearly states that illegitimate minor children are allowed to travel overseas with their mothers without the father's consent.

What a fvcked up law in PI.

I bet you quite a few children are kidnapped by thier mothers every year, when they get a Visa to go to another country to live :wow:

I'll bet with quite a few single mom's, the father bailed out before or when the child was born.

I agree and understand

I just see too big of a window of fathers having their children kidnapped by the mother and taken to another country.

US Law is very very strict on children leaving the USA, whether married / divorced / etc.......

had I known the law I should have had my Mother in law bring my wife over that way and I could have skirted the entire process and much mula!!! :rofl:

So true! And a lot of them would try to extort money from the mothers in exchange for consent. Others won't give consent and when the child is left behind, the father would not want anything to do with the child. Our laws recognized this and put an end to it.

Back in 2002, my ex-husband did not return our daughter (then 3 years old) after a routine visit. The reason? At the time, I was dating a Brit, and he and his family came to the conclusion that I would leave the country with our daughter in tow. Granted, we had thought about getting married, but back then, the laws were such that I needed to secure an affidavit of consent from my ex...and knowing him, he would not have agreed to it.

It took me almost a year to get her back, and I had to go to court to do so....via Habeas Corpus...since parental abduction is not illegal in the Philippines...talk about a screwed up law. That year was hell...no mother should ever have to go through that.

My ex has never held a job for more than a year, and has been unemployed for the last 7 years. Good luck trying to get child support out of him. I never asked, and nor has he initiated...you would think that someone who "loves his daughter so much" would be man enough to realize that he has responsibilities other than to his drinking buddies...where he has freely spent whatever money he gets his hands on.

Am I happy the law for securing consent changed? Hell yes. My daughter deserves the best life she can possibly have, and we have found it here in our new home, with a truly wonderful person who is the best husband to me and the best father to her.

I would not have it any other way.
