i can not freaking believe that my I-130 was approved today. What are my options since my husband was approved for his I-129F last week? :luv:

Congratulations! For now, you can keep the both processes running and see what happens. I-130 will be at the NVC for around two and a half to three months before it will be forwarded to the Embassy/Consulate, but the I-129F will be at the NVC for about 1-2 week. NVC will send the I-129F to the Embassy/Consulate after it assigns a case number. Looks like, you will get the I-129F interview soon. You can go back to the native land for the CR-1 (I-130) interview or you can adjust your status in USA after the arrival with K-3 visa.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Congratulations, jerseygal, and welcome to the club. A few of us have approvals for both I-129f and I-130. Simple_male laid out the options. There's little doubt the I-129f will get the interview quicker, with entry to the States sooner.

After that, we can adjust status through the local USCIS office. It looks like Newark is relatively slow. But it may not be that much slower than allowing the I-130 to chug along and then have hubby go back to his homeland for the interview.

If it's important to have him working asap, we have to estimate the fastest route, and frankly, I don't have any bright ideas.

If it's a huge expense to have him go back home for another interview, then AOS may be the answer, albeit a slower route to the greencard.

Don't try to make any decisions for a few days, until you come back down from Cloud 9. I feel like I've drunk a gallon of coffee and have turned into a crazed maniac. That's what getting the approval has done to me!

jerseygal,

Same as they were before - your husband can apply for either a K3 non-immigrant visa or an immigrant visa. His - and your - choice.

If time to entry is the most important consideration, the K3 is still in the lead.

Dear JerseyGirl,

You mentioned that it is important to work ASAP. From what I have seen, that can happen by getting a work permit before getting a "green card." I don't know the name of the form to file, but I had a friend who brought a fiance over on a K-1, married her, and got a work permit all in a few months.

jerseygal,

Point of clarification - I-129f and I-130 are petitions used to qualify a person to apply for a visa. They are not visas.

The answer to the question as you should have asked it is 'yes'.

Yodrak

Thank you everyone. It is important that he arrive here ASAP but not for work, just becasue I MISS HIM SO MUCH. Is it possible for him to come here on a I-129F visa then go back to Morocco for his I-130 interview? Thanks again.
