My husband went of of F-1 status 2 weeks ago and he is worried that the INS will come pick him up out of our house one night. Does anyone know about that? Can they just come pick you up if you haven't done anything except go out-of-status? I was out of status in Germany for a month and nothing ever happened. But I know things have tightened her in the USA, so now we are all worried. We haven't sent the AOS yet because we are missing my amounts from 2003 and 2004 taxes for the I-864, and he wants to send it without those. (The IRS lost my request for these documents) It's going to be another week or two til we get them. He just wants to have the file opened and doesn't care if they send it back and have tons of RFEs! So my question is, can we just go ahead and send it without the tax info, or should we sit and wait and risk the INS coming and picking him up and taking him to jail to try the removal proceedings? Please Help! :help:

Tell him to relax.... nobody is going to come in the middle of the night and drag him off to be deported.... it would take them months to get a court order to do that....

Wait for your tax papers and then file... a complete AOS package is far better than one that needs lots of extra bits sent... things get lost all the time at USCIS...

Your 2003 and 2004 tax information is not required. You can include it if it will make your financial situation look better - and if you need to make your financial situation look better. Otherwise it's not much of an excuse for delay.

I thought on the new I-864, you did not need the actual tax transcripts returns but for the first year (unless as you said it would boost your case); however, there is still a spot where they ask you to write in those numbers (section 25).

Agreed. Re-reading the original post I see that j9Melihi seems to be missing the numbers as well as the returns themselves.

I agree. I only sent in tax returns for 2005 and we had no problems at all.
