Hi. We are in the process of gathering evidence for the I-751 submission next month. We were wondering about the tax returns and whether to submit it as evidence since we did not file a joint income tax return. We both filed a separate return since it was better in our case.

How important is the tax return evidence? Should we still use it as evidence even though it was filed separately?

We do have evidence for our house, car and bank accounts etc.

USCIS likes to see tax returns. As long as your returns were marked as married filing separately, the spouse was listed on the return, and the address is the same, then you should be good to go. They know that some scenarios, it is best to file separately and not jointly for better tax return deductions, so it is not negative point against you.

Ok thanks. Is 1 year enough? Also do we submitt both of them (mine and spouse)?

No, you need to include the past two years, or since you got your GC. So, if you are filing next month, that means you have been a LPR since (estimate) December 2008 so you need to show returns for 2008 and 2009.

Once the returns show that you filed married and it has both social security numbers you should be fine. We only sent in one tax return statement and we were approved.
