Letter from the Embassy

OK, sorry if this isn't the right place to post this but I'm really confused...

Our I-130 and I-129F were approved at the same time - on the 16th of Aug. The on the 31st of Aug we called NVC and they confirmed that the K3 is administratively CLOSED... and TODAY I get a letter form the USE here in Sofia, saying that they are ready to schedule an interview for me FOR THE K3 VISA (?!?!)... WT**??? I couldn't get a hold of anyone at the embassy, but if anyone can share a similar experience or give some advice, it would be greatly appreciated!!!

I wish I could give you an answer, but same as you I am clueless!! I hope someone that knows will give you some sort of advice, also can you call NVC or your lawyer?? keep me posted!!

Well, hubby is gonna call them when he's up and I'm waiting for the lawyer to respond... I hope I can actually talk to someone from the USE tomorrow and get some things cleared up cos this whole miss-communication is sooo frustrating...

Milena, this shows they are still processing K3 visa

You can talk to the Embassy in Sofia and request them to close K3 path since you are pursuing IR1/CR1 path. It has to be done, otherwise they might treat it as 'no show off'.

DoS Hotline will know more about this, since the letter came in from The Embassy (A DoS entity) -

so call DoS Hotline (# in my profile), get a Human and inquire for casefile status on the K-3.

smells like administrative glitch somewhere, but if the Embassy is choosing to follow the K-3, now you must decide with path to take, aye?

Thank you Loto and Darnell!

I was able to speak to an embassy person today (for once she was a nice lady ) and she said that this was a standard letter that they send when they receive info from the USCIS about an approved K3. She also said that there is "NO POINT" in continuing with the K3 since both Immigrant and Nonimmiigrant petitions were approved (really? ).

So thankfully we are still able to continue with the IR1/CR1 - we just gotta call NVC and confirm (AGAIN) that we are not goin for the K3 and to ask them to assure us that the IV bill is ready to be paid so we can move on!

Thank you guyz for sharing this very confusing situation with me and for the support also! I just hope there are no more immigration hick-ups till the end of this journey!

Well, apparently I have to make some corrections to my statement, because it turns our that NVC haven't closed our K3 and said that they don't ALWAYS closed them. Also, they said we have to call the USE here and request for them to close it. Now, here is the vicious circle part - the USE tells us "Call NVC to close it" and the NVC says "Call the USE".. So basically, no we have an instruction letter for a K3 interview and the AOS&IV bills ready to be paid... :wacko:

I really hope we get things resolved Tue, cos this weekend is not gonna be a very nice one...

I still wish you all a good and stress free time tho!

And hope no one has to go through this cos it's enough to make you go crazy!

We'll see on Tue and hopefully we can still pursue the IR1/CR1... If not - well, I guess we wont have a choice but to use the K3... I'm just hoping for the best!!!

Milena, It must be possible to close K3. Keep contacting them. When is K3 interview scheduled?

Milena, Then you don't have to worry on K3. When NVC completes your process, CR1 interview will be scheduled meanwhile. Nonetheless, you need to be in touch with them to close K3. Why don't you email to the Consulate about IV and AOS payments or other proof showing that CR1 is in process?

You know what? That's not a bad idea!

Unfortunately, I'll have to suffer the waiting until Tue since it's the 6th of Sep is a national holiday here too(that makes is double for the USE )... But I'll call them (hopefully I'll get in touch with the nice lady again) and see what they say. It's really frustrating, since we got the AOS&IV bills ready to be paid and a instruction letter for the K3... Not to mention our attorney seems more confused than we are... :huh:

i applied for I-130 (CR/IR-1) and I-129F (K3) petition, only one can be processed by NVC. NVC will see which case was approved first. Lets take couple of scenarios - 1) if K3 gets approved at same time with CR/IR-1, NVC will close K3, and proceed with CR/IR-1. This is to avoid multiple visas and further delay in duplicates.

2) If your K3 gets approved prior to your CR/IR-1, then they will proceed with K3.

2a) Further if your CR/IR-1 gets approved and NVC receives while K3 is being processed, they will upgrade your case and request further docs.

2b) else they will continue with K3, and once beneficiary is here, you can take the approval of CR/IR-1 and upgrade your case to file residency of green card.

3) If CR/IR-1 gets approved first, then NVC will continue with this, and they will close K3 since it is useless.

Important Notes: This is confirmed by USCIS, that given the both cases take same amount of time, it is recommended that you only proceed with appropriate case in order to avoid issues. Following up with K3 will delay your I-130 slightly, because the docs are sent over to Border security aka homeland security.. they will proceed with both cases then it goes to USCIS.

Subsequent filing of K3 was recommended before because CR/IR-1 would take year to process, while K3 would take 6 months. Now both take 5-6 months.
