Hello Guys, need some info. Only what is fully legal.

How soon can CR1 holders start working? Do they really have to wait till the SSN/GC via mail?

I have this situation.. my company has operations in US and they are kind of ok to gimme a transfer to their US office. But they asked me clarifications abt the employment eligibility with CR1 visa.

I read somewhere, CR1 is like a temporary green card and holders are eligible to work. So is it like, once I enter US I can join work from next day?

(Ofcourse, I maynt be joining work next day or someth..but still, to be clear on this. They are reluctant to gimme a leave for two weeks also)

I know a job is precious and I would very much like to hold on to it, if i have an option. Besides, I like the company and the work.

Yes you can work the next day; at POE,they will put a stamp in your passport which acts as a temporary greencard for a year. Most employers will require a SSN to work, but you don't technically need it right away, and in any case, can get it within 2-3weeks.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yep work right away!! A few of the Cdn people, got jobs right away with No ssn---their work just held their pay until they got their SSN, then paid them!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

The I-9 form lists the specific document requirements for work authorization. A GC, or an I-551 stamp (completely equivalent) is all you need, by itself, to be work authorized. Not having an SSN may complicate having a bank account, and therefore direct deposit, and probably complicates tax withholding by the HR department, but a SSC is not required to be work authorized for the purposes of the I-9 form.

Now your typical HR department might get slightly confused and think a SSC is a required document, because the typical combination of documents USCs use to show work authorization is a SSC and their unrestricted state driver's license. If they've not hired a lot of immigrants in the past, the HR department might not ever have seen any other combination of I-9 documents.

JJ, What everybody said is correct. I-551 stamp is temporary GC. You can work with your employer. But they can't pay you and withhold taxes until you get SSN. Since you know your employer, they can adjust it and do everything properly as soon as you have SSN. If you don't get SSN in 3 weeks, but plastic GC, visit the SS office and apply one by filling SS-5 form. Also, get a bank a/c after getting SSN.
