Letter from employer

Hello friends, I've been reading some of the actions taken by some of the VJ'ers about employment verification and I'm a bit confused because I see different things done.

I seen that some of the letters that people get from their employers actually states how much they make annually, hourly or monthly.

I seen some that says as long as you have your tax transcripts to send with the AOS package.

My HR manager would never state how much I make on any letter. All she will do is verify that I've been employed since, is currently employed and is a full time employee with full benefits.

My question is - Would the NVC accept just a letter of employment, tax forms with gross income highlighted and check stubs showing income from when I started that job and gradually showing income from the time there to current?

I had a hard time in Cambodia explaining to the Ministry of Information when I went to get my marriage certificate about how my HR would never put down how much I make and that they should call her if they want to know. They believed me after many minutes of arguing and standing my ground.

Thanks and Good Luck to all !!!

Sam,

Why will your HR department not put in writing the facts of your employment. For example: Mr X has been employed as a marketing manager since June 2008. His salary is $50,000 annually. If your earnings are commission based then they ought to be able to state what you had earned year to date.

You can demonstrate your current and continuing income (that is what is evaluated by the interviewing officer at the consulate, not what you have made in the past) by submitting recent pay stubs / earnings statements.

The tax transcripts are typically sent to demonstrate that you have filed returns as required during the preceding 3 years. (I-864 instructions, page 8)

Why did you have to show your HR letter in Cambodia to get a marriage certificate ?

Anyhow, to answer your question the NVC will accept a Letter of Employment, Tax Transcripts and Pay Stubs. These are essentially only the items they will accept for the I864 unless you are sending proof of assets or cosponsor (none of which you mentioned applies to you).

In your case the Pay Stubs serve as proof of current income. The Letter will not prove current income, it will only be able to validate that you are actively working at the company you say you are.

I would not worry that much about the fact your letter does not have your salary on it. If your current salary clears the poverty limit then you should be fine. Only if you are on or fairly close to the border does having 6 months of Pay Stubs and a Letter really help to convince the Embassy of your ability to provide.

Thank you.

I should of worded it better about what i had to deal with in Cambodia. It was actually the Anti-Human Trafficking Department. I guess it's a new thing they're doing because they have had cases where Cambodian women were pretty much set up by marriage brokers and ended in brothels in Korea and a few other countries. I'm guessing precautionary measures. I had to go through what was pretty much a "stokes" interview because they wanted to see if we had a real relationship. Stories matched and I ended up asking the interviewing officer more questions then he asked me. I know in a county like Cambodia, one can basically pay to get paperwork done. Being that I wouldn't bribe anybody and I was ethnically Khmer and seen as an easy buck. They wouldn't issue the certificate if I hadn't gone through it. It's a new thing so i assume that they were new to it also. One big bonus was being able to speak the Khmer language. That made explaining things easier.

yeah your boss or whoever writes the letter should say what your yearly salaray is, even if it's hourly. if it is hourly you have to convert it to what it would be per year.
