I dont understand the timeframe of uscis of the approval some get approval so soon in 15 days and most are waiting and waiting more than 100 days i dont understand why they take so long after receiving the reply of RFE despite the message that it says THE PRELIMINARY PROCESS HAS BEEN COMPLETED AND NOW SOON U HEAR A DECISION ON THIS CASE. Did u also got the same message as i got this one and it also mentioned that it will not take so USCIS pls give us a fresh air to breath or we going to choke so pleas response and give us a big leap from america to the beneficiary country

I have no idea. I received that message too. When I got it I thought 'wow, maybe this will not be so bad'..hmm, that was then, this is now. I really do not understand the process and the lady in the congresswomans office is trying for an update for me. Unfortunately todays update was that my case was forwarded to the CSC. I just hope the next one is better but I am sure it will be that I need to allow 60day before I should expect an update (aka 9/11).

As for fresh air. Yea, I feel like I am sufficating. My job, sleep, and stress level are highly affected. Luckily, even though this is so hard, the love we share is not hurt by it. I occasionally get asked to 'promise I will not leave' or have to comfort her, but that is easy. Shes my baby forever. This has not caused fights, disagreements, or us to take any issues out one one another. Instead we comfort one another or inspire all we can. Yea, we are hurt, and will be until the USCIC has mercy on us. Till then, faith, love, and I gotta say some sarcasm are the key.

It's unfortunate for everyone who got caught up in the IMBRA fiasco. However, I do believe it's going by RFE date now. Some cases are going quicker than others, every case is different. The USCIS started things over after March 6th. When they get the RFE back, they give themselves 60 days to adjudicate the petition. If you are under 60 days of processing the IMBRA RFE, then you are within the timeframe and unfortunately... on schedule. I think everyone will hear something by the end of the 60 days, if not then you can call for answers. It sucks!! but if you view it from this perspective, then you should have faith that it won't be much longer.

07/19/06- RFE received in mail, IMBRA

The email I recived from CSC indicated that it was 30 days, not 60. Where did you hear 60?

Unfortunately, it is impossible to understand the timeframe as there is NO TIMEFRAME. There is no "30 day rule" or "60 day rule". The only hard and fast rule is that technically, you cannot complain unless your petition was received 30 days after the "current processing date" on the CSC site. Their current processing date has been March 6 for eons. That way, no one can complain.

One thing we have learned, especially since IMBRA, is there is no rhyme or reason. There is no processing order - not NOA1 date, not RFE return date. There is no explanation. There is no logic.

The first set of RFEs said "you should hear something within 30 days". Apparently the second set said 60. That did not mean that they have any obligation to finish processing in any length of time. That also did not mean you are not allowed to inquire about your case status. The again, it doesn't really matter since their official response is that you need to be 30 days past the date filing date they are currently processing which has been and will continue to be stuck on March 6.

Any congressman or senator can make an inquiry on your behalf at any time - it just doesn't guarantee that you will actually get any answers (no matter who makes the inquiry).

Apparently today USCIS is now stating that there is no processing order - not NOA1, not RFE return and that we should all shut up and wait until 6 months have passed. The plot thickens . . .

It's been a long hard process. Lots of us have gotten stuck in the IMBRA mess and now the backlog. Listen, everyone is in the tail end of this wait. USCIS is working on it. Everyone will have there NOA2 soon enough. It's very unfortunate everyone got stuck in the middle of a law change. USCIS has given themselves a window of 60 days, nothing is guaranteed. They don't want to hear anything until after the 60 days, and the truth is, there is nothing to tell us. It's waiting to be adjudicated or it's in name checks. The next unfortunate thing is.. everyone will be contacting there congress people for help now that there 30 days past the IMBRA receipt, when USCIS says to wait 60. Now they will be short with others and tired of hearing about it. Some people who really need the help won't get it. The bulk of the waiting was IMBRA, and waiting for the RFE. Now that everyone has the RFE and sent it back, we're in line.

The wait was never this long before IMBRA and now that it's calming down, it will be back to normal. Just bad timing to file an I-129F

I'm sure you mean well, really. But we have not seen more than a few approvals from CSC in the past several weeks and there is simply no proof that we are in the tail end of this wait. YOU may very well be at the tail end since you recently filed through VSC, but for those of us who filed at CSC in March, there is simply no way to know how much longer it will be. In fact, if there is any truth to the rumor that USCIS is now telling people to wait until SIX MONTHS have passed, then many of us still have a long way to go. You should also realize that each consulate has different wait times for interviews. Many of us will wait an additional 6 months for an interview date. The processing of the I-129F was supposed to be the shortest part of this process. I know you're trying to keep spirits up but for many of us who have been going through this since March, nothing will really help until we have true, accurate and concrete information (and it seems more than obvious that the only way we may actually get that is by getting the assistance of our congressmen or senators).

Well said, Kit. I was frustrated to the point of insanity just trying to get some information on my case - this started back in May, trying to contact the embassy in Paris (impossible), and not having a clue about IMBRA or anything else until I stumbled onto VJ. Since then, it's been an arduous task trying to get info until I finally decided I'd waited long enough (nearly 30 days after CSC acknowledged receipt of the IMBRA RFE) to contact my congressman for help finding out where the heck my file was (accidentally shredded maybe, I had no way of knowing). My experience was positive in that the immigration specialist phoned the day after I faxed over the privacy release and copies of all official docs (NOAs,etc) and a letter stating what my concerns were. He followed up quickly, calling CSC, also NVC, and today was the first time I actually had an inkling of what was actually going on with my case. So, Kit, thanks for the repeated valuable advice and instructions you have posted over and over on how to contact senators and congressmen. Very helpful and much appreciated!!!!

Keep yer chin up, now that it sounds like some of us pesky recalls are out of the way, they can get cracking on the March and April castaways. I may share in a celebratory shot of Cuervo when I get home! :dance:

One point about what you are saying. If they are saying '6 months from the NOA1' as you are stating, then one would be led to believe that they would try to get the oldest NOA1's approved. That obviously isnt the case. I am fed up, I have a right to be fed up (as do many others). The people that filed recently or in VSC has no clue the frustration and them being the ones to say 'be patient' is killing me. Maybe its meant to help us, but it is not addressing issuess such as '15 day approvals' when what you are saying is 'wait 180 days before asking what is going on'. Hell with this idea. I will keep inquiring.

no, I never said anything about 6 months. All I said is the majority of the waiting was for the IMBRA RFE. Due to IMBRA all petitions were put on hold, some had to be sent back, then some transferred, a couple got lost, but the reason for all the waiting was for the IMBRA RFE. Now that the waiting is over for the IMBRA RFE (except for iceyspots case) things are back up to speed. When you got the RFE you sent it back. USCIS informs you to give them 60 days before we inquire.

So I believe that there is no hold up anymore, just the regular waiting period as if you started all over again after IMBRA. I know it's hard to do this but you have to view the IMBRA RFE receipt notice as your NOA1. Some people "William33" and others are getting there 2nd RFE now for normal things. This is because there was no preliminary processing before the receipt of the IMBRA RFE (says so in the memorandum) so screw the e-mail. The process starts over from the point of the IMBRA RFE receipt notice.

So, some people have sent in there petition in March and had to wait all that extra time for there IMBRA RFE. They endured all the unknown, and all the "what are they going to do? will they make a new petition? are they sending an RFE". I have been following IMBRA with all of you since the first IMBRA thread.

VSC is the faster of all the service centers, this is fact and can't be changed. So people shouldn't compare themselves to different service centers. The service centers are adjudicating at a pace similar to pre IMBRA. If you look at everyones IMBRA receipt notice date, they are all around the same time. Late June & July, mostly in July. It's obvious there not adjudicating according to original NOA1 date. Hence why everyone is over 100 days. Everyone is back at the beginning starting fresh with there IMBRA RFE receipt date as the NOA1.

Are you aloud to be upset? hell yes!! do you have the right to knock down the door at USCIS? do whatever helps you get though this. Personally, I like to think that the people who have been waiting for over 100 days are not some special case of neglect, but a case of unfortunately filing right after March 6th, having to wait the longest to figure out what to do about IMBRA, and finally to get the RFE. So, people above 100 days, don't worry!! the NOA2 is coming.

06/30/06- sent I-129F petition to VSC.

07/11/06- NOA1 (received in mail)

07/19/06- RFE received in mail, IMBRA

07/28/06- e-mail, IMBRA RFE received at VSC

09/11/06- called VSC, told I'm with an adjudicating officer

09/25/06- called VSC, told to file expedited service, outside 60 days of RFE received date

09/26/06- sent expedited service request to VSC via fax and snail mail

09/26/06- Senators and Congressman making inquiries into my petition

09/29/06- expedited service request approved by VSC director

10/04/06- e-mail NOA2 approved!!!!!!

10/05/06- NVC received

10/06/06- NVC forwarded to Poland Embassy

10/16/06- Packet #3 received

10/17/06- Packet #3 sent to US Embassy Warsaw

10/30/06- Packet #4 received

10/30/06- Interview scheduled for November 22nd!!!

11/30/06- Visa in hand, via DHL!!!!

12/05/06- Ania and I arrive together in the USA

02/11/07- Ania applied for Social Security Card

02/17/07- Ania and I were MARRIED!!!!!!

07/24/07- Social Security Card in hand- after some minor issues and a little procrastination :)

10/14/07- I-485, I-765, and permission to travel mailed to USCIS

10/17/07- Received NOA1

12/17/07- I-485 shipped to California Service Center for faster service

12/17/07- I-765 approved new card should be mailed within 30 days, Advanced parole approved

02/28/08- AOS APPROVED!!!! PERMANENT RESIDENT CARD RECEIVED!!!!! (card received couple weeks after approval)
