I came to the U.S. on a J-1 visa, left the US and came back with an F-1 visa. I am currently adjusting my status to permanent resident. My interview is scheduled for sometime within the next three weeks and I would like to know how to tell if my J-1 visa is subject to the 2 year residency requirement. Also, if it is, what do I do to prevent a denial of my i-465?

It says on your DS 2019 if you still have it. Bottom left hand corner..

I'm sorry, where do I find the DS 2019? I don't believe I was given one.[Edit] I received the J-1 visa for my my last year of high school. Are DS 2019s issued for this?

Eu tive um J-1 visa com o "2-year rule" ha anos atras (cerca de 1994).

A frase "2-year rule applies" constava do proprio visto do consulado no passaporte.

Eu fui obrigada a voltar ao pais porque eu passei 4 anos fazendo o doutorado com bolsa de estudos pelo governo brasileiro.

Neste caso, eh considerado uma obrigacao retornar e retribuir, no Brasil, o recurso investido no estudante.

Eh claro que vale a pena verificar, mas eu ficaria surpresa desta regra se aplicar a alguem que simplesmente fez o ultimo ano de highschool no US.

Normalmente, o intercambio eh pago do proprio bolso.

would you mind translating? Babel is giving me an incoherent translation. Also, I received no money from any government and no indication of a residency requirement is stated in my passport. I can't find my 2019 and I don't believe I have one.

Sorry about that....my mind was somewhere else.

I had a J-1 visa back in 1994.

On the visa stamp given by the US consulate, right there on my passport, it said "2-year rule applies".

This was so in my case because I came to the US to do my PhD on a full fellowship from my government.

So, naturally, they expected me to go back to return the investment.

I do not know if visas issued from US consulates around the world look the same or not.

Normally, a highschool exchange student comes on its own money.

So why would you be required to go back to your country ?

I think that if you left and then were issued a F1 visa within two years of being there you are probably not subject to the ban. They would have denied your F1 otherwise I would think. :) But, make sure this is the case.

10-26-2010 Green Card Arrived!!!!!!!!

No USCIS till 2012. Wohoooooo
