Ready to send out AOS. Have last minute questions..pls help

Hi VJ Friends,

I am a bit late, but my AOS package is ready to mail out tomorrow. Yay!! I have included the

following and have questions. Please let me know if I am missing anything.

I-485

I-765

G325A

copy of marriage certificate and his birth certificate

copy of NOA2

check payable to DHS for 1010

one or two pics of wedding

copy of 1-94

copy of husbands passport (biographic information)

copy of his birth certificate

1-864

my employment letter

tax returns for 3 years

Do I have to include employment letter in addition to paystubs? As I have all 3 years tax

returns. I just want to know what is the most important evidence of income information. My

income is above the poverty lines so its not a requirement to include bank info.

Please confirm and let me know if I am missing anything else as I am going to send it out

tomorrow. I am putting all this together in a folder with already acco fastners. Does it

really matter how its assembled.

Thanks again for all the wonderful people that answered my prior questions.

You need more than the bio page from his passport. You also need a copy of his visa, and you should also include copies of the entry stamps.

The wedding pics are not necessary.

You need to include passport style pics of your husband.

You need to include a copy of the NOA2 for the I-129F petition.

Did you get an I-693 from a civil surgeon?

Is his birth certificate in English? If not, did you include an English translation?

Whether or not you need to include bank statements has nothing to do with whether your income is below the poverty guidelines. It has to do with whether you need to bank statements to demonstrate regular income, such as if you're self-employed. If you have the tax transcripts, and they show you meet the guidelines, then you don't need to include any other evidence of income.

Don't use ACCO fasteners for the AOS packet. Use these guidelines instead:

Thanks for answering my post so quickly :). I did the read the guids for AOS instructions

Yes he got his medical done in India, and according to what I read its still valid right? It has

not been a year yet. So, he should include the medical from India?

Hi Star-

His medical is still good, but you should check if his vaccination supplement is up-to-date. Some people are receiving RFEs even if it is. In our case, we just opted to get it transcribed even though the box was checked as being complete. I just didn't want to take a chance. Also, I suggest that you apply for the AP even though you might think he won't need it. There is no extra charge, and it is easy to fill out. You will have it in case of some unexpected need to travel abroad. Just treat it as a separate application and include the 2 photos and anything else requested. It can all go in the same package, you just need 2 photos for each part (AP, EAD, and AOS). Good luck to you!

The use of ACCO fasteners is recommended for petitions being sent to a USCIS service center, like an I-129F petition.

Petitions sent to the Chicago Lockbox and National Benefits Center have a different set of guidelines.

Your husband should have gotten a DS-3025 vaccination record when he got his vaccinations. There are some check boxes at the lower left side of this form. If the "Complete" box is checked then you shouldn't need an I-693. If either of the "Incomplete" boxes are checked then you must have an I-693 signed by an approved civil surgeon certifying that the required vaccinations have been administered. The details are in the AOS guides.

Even if the DS-3025 is marked "Complete", that doesn't necessarily mean you're out of the woods. For reasons nobody has been able to explain, medical records often mysteriously vanish somewhere between the Port of Entry and USCIS. There have been a LOT of VJ members who did not get an I-693 because their DS-3025 was marked "Complete", and they STILL got an RFE for the I-693.

Some people have followed the guides, and had the civil surgeon only complete the vaccination portion of the I-693, and they have STILL gotten an RFE. Apparently, USCIS is losing medical records, and it's been happening quite a lot. If this happens then you've got no choice but to repeat the medical exam and get the entire I-693 completed by a civil surgeon.

I you don't submit an I-693 then there is a possibility you will get an RFE requesting one. A lot of VJ members decide it isn't worth the risk, and go ahead and get an I-693 signed by a civil surgeon.

Just treat it as a separate application and include the 2 photos and anything else requested. It can all go in the same package, you just need 2 photos for each part (AP, EAD, and AOS). Good luck to you!

Everyone has different results when they spin the USCIS Wheel of Fortune, but I just thought I'd throw this out there...

I prepared three AOS packages; one for my wife, one for her daughter, and one for her son. Each included an I-485, I-131, and I-765. We only included two passport style photos for each entire package. All were approved without RFE or any other unusual delay. The AP documents will use the picture you submit with the package. The EAD and green card will use the picture they take at the biometrics appointment.

In other words, I don't think it's necessary to include a separate set of pictures for each application. Your mileage may vary...

Jim - Thank you for the helpful information about the 693 forms. This has been very helpful to

keep in mind. I definitely do not want an RFE. I think I have had my share of those during the

first initial process..lol

Menina- Thanks for letting me know about AP. I might as well do it. His I-94 expires on the 15th

the goal is to at least get it out tomorrow, and if it requires extra time I will get it done

by Friday.

As far as assembling the packet. I was just going to paperclip it and seperate it in a manilla

envelope. I read the guides on the USCIS home page, and yes it states to use paperclips. So,

thanks for clearing that up Jim. How did you guys put your AOS packet togeter? Just want to

get some ideas so the officer reviewing our file is not lost..lol

I used three manila envelopes - one for each applicant. Each manila envelope contained a stack of documents held together with one large clip. The check was on top, followed by the cover letter, followed by each document set listed on the cover letter in the order listed. If a form required additional evidence, then that evidence was included just behind the form in the stack, and attached to the form with a small paper clip. For example, the birth certificate and passport copies were behind the I-485, the tax transcripts were behind the I-864, etc. I made a separate cover page for the G-325A. I put the passport style photos in a small ziplok bag and taped this (on three sides - not the "zipper" side) to the cover sheet.

Note that I did not include any piece of evidence more than once in the same package. In other words, I didn't make a separate copy of the I-94 for the I-485 AND for the I-765, nor did I include separate sets of passport style photos. I pretty much followed the VJ guides and provided precisely what was listed there.

I put all three manila envelopes in one mailing envelope and sent them all together.
