Dear VJs from Ukraine and other countries,

We are currently waiting on our CR1 Interview date to be assigned by the NVC, and surfing the links I caught a crazy idea in my head: what if I try to apply for a visitor visa right now? Yes, I do understand that the chances are the smallest, but still... I want to see my husband so much! He will not be able to come here till the Interview time, so I just wanted to kill the waiting time getting to see him... Yes, sure I did read about folks being denied their visitor visas applyed for while waiting on the family based visas, but still... Well, I still have a small hope. He is going through the difficult time now and I am really worried... I would love to be there to give my full care and support... And, certainly, I am pretty sure I will return back to my home country (for the interview!) as soon as I get ensure that he is doing just fine - let's say in a week or two!

What do you think, guys, how many chances I have?

You probably will not get it - since you have a visa in process right now and your from the Ukraine...

If you apply, you will waste time and money if denied - if you have that freely - go for it, but I would just wait for the CR-1.

And, certainly, I am pretty sure I will return back to my home country (for the interview!)

Pretty sure? You should be 100% positive you will return back for the interview, if they grant you the visitors visa!

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Well, after talking to Alan I see it's not a good idea at all... Well, my husband thinks that it can possibly mess our case up. Well... By now we have waited almost three years, so one month more or one less - what's the differenvce? This waiting is really killing me...

Well, yes, I am 100%+100%=200% sure I would return back! But thank you for the respond... Just a crazy midnight idea which unexpectedly came to my mindd... I better go take a chill pill right now!

You probably will not get it - since you have a visa in process right now and your from the Ukraine...

If you apply, you will waste time and money if denied - if you have that freely - go for it, but I would just wait for the CR-1.

You can apply as much as you like and pay for each application. The US will not refuse your money and you could actually help with the deficit situation. Do not plan on actually receiving a tourist visa. Do not plan on being treated courteously.

It doesn't matter if YOU are sure. You have to convince the consulate that THEY are sure. You have a HUSBAND in the United States which entitles him to apply for permanent residency for you, whether you get here legally or not. He can also apply for permanent residency for any child that was under age 18 when you married and still under age 21. All that said, the consulate ASSUMES you will NOT return and you have to show them why you will.

A visa is just a postage stamp to get your delivered to the country. When you are already married it does not change your ability to apply for permanent resident status. People from Visa Waiver Countries get married to citizens, come to the US and never leave. Then just apply for permanent residency here. They do it all the time, yes it is illegal. So what? In the case of Ukraine, you have to have a visa to enter the country, that is the problem. Were you from, say, Germany, you could get on a plane this afternoon and just come here and never leave, or leave...your choice.

The consulate in Ukraine is simply not going to give a tourist visa to somone that can so easily immigrate and not return. I am not certain what you could use to show a COMPELLING reason to return.
