I remember when we filed for K1 last year, our I-134 did not have any attachmentS such as IRS, W2 or anything else..

since my fiance' is working here in PH.. and I was approved.

He returned to USA last May 2010, we filed for K1 again this year since we did not get married last year when I went.

He still works for the same company as last year- but he works remotely, I was just wondering what would be the case

this time since he's back in USA? we did not have any attachments with our I-134.

Any idea on what to do with this???

- He works in PH

- He works for a PH company, hence he did not have any property in USA but he now lives with his parents temporarily while he's waiting for me.

- He recently just got a bank account -- just few mos right after we submitted our K1 application

- W2 does not apply

- IRS- I have his current W1020

- His earning is way above the poverty guidelines

- I got his bank account statements just today via email- but embassy requires 6mos--so...

What else could I possibly present/attach with the I134F?

I'm actually surprised they accepted the first I-134 without any evidence (the instructions state you need evidence).

He should get his IRS tax transcripts - they would carry more weight than just having the 1020 - you will need to explain why he didn't have a W-2 (since he is working overseas, not a big issue).

Moving from K-1 to Embassy - I-134 related.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yeah, we weren't expecting that either. We had our IRS ready tho last year but they didn't ask so

we just let it that all we have was the I-134...figured maybe bec he works in Philippines and

can't really show other stuffs..

but according to some that told me -- that once you put enought amount on the salary amount on the

form -- that is above the poverty guidelines is just ifne even if you have put 0' in almost all the lines...

I really don't know... hope this time should work again with no issue since we have our previous records..

Yes - I figured that is what you meant.

If your income is sufficient in meeting the level needed - you do not need to show any more assets/savings.

However, each embassy may require more.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

everything went just fine. I was asked for the ITR... and gladly provided the consul with the document.. :)

"Wage and Tax Statement" for the year. 1040 is enough I guess, because that is what I gave the consul. I didn't give other forms., but I suggest if u can provide the other forms please do so.

What is the W-2 means?

I have the 1040 Form (US Individual Tax Return) 2009 from my fiancee and I can't find W-2 with it? Thus, 1040 form is enough or still I need a copy of W-2?

Really depends on the embassy - Ankara requires both (W-2/1040) for the I-134.

For the 864, you would need both of these items, one without the other cannot be used. (states this in the instructions).

(Best to go with IRS tax transcripts - has everything you need).

Now - if your self-employed, you will not have an W-2, so you would have to show other forms to prove the income/taxes. (transcript again helps here)
