Canadian mom needs advice about immigrating to the US.

Hey everyone, Canadian wife here, in the midst of educating myself on the brain-splattering visa process, and have a bit of a confusing (and I'm guessing rare) situation.

I have a son of which my American husband is not the biological father, currently living in the Philippines (where he was born) with my parents while I get everything settled for him here in Canada. I will be going back to get him sometime soon so he will be present at interview time, but wanted to begin the CR-2 process as soon as possible. We have been told that we will need written and signed permission from the biological father to accompany his application, but as the "sperm donor" in question decided not to take responsibility for any aspect of my pregnancy, or my child, I did not put his name on the birth certificate. I put no name down at all, and have assumed this means I need no-one else's permission, but would love to know if anyone out there has a more educated guess on possible solutions or unforeseeable problems with this.

Any advice at all would be very much appreciated by all three of us.

You might want to post this on the PI forum to see what the legalities are for a PI boy born with no father listed on the birth certificate.

I know my Canadian sister has been asked 95% of the time she visits me in the US for a letter from the father - and that's just for a visit

If you were not married to the boys father then there is no need for a consent letter from his biological father. Since you will be dealing with the Embassy in Canada they won't be up on Philippine Family Code so follow the links in my signature to get the relevant sections. Print it out and include it with his DS-230 packet at the NVC Stage.

Just to be safe also bring a printed copy (highlight the relevant sections) with you on the day of your interview.
