EAD: Stranded Please Help

Hello Everyone,

I am about to renew my EAD card that expires in November 2010, I contacted my Attorney but He wants $300 to fill the forms and $340 for the EAD fees (total of $640). After reading the EAD forums on VJ, many members suggest doing it yourself (myself). Here is my case: I got my EAD from a previous I-130 that I had applied with my spouse. I was then abused by my USC spouse and filed for I-360 while the I-485 was pending. Since I had my now EAD from a previous case do I need to apply as a renewal or a new EAD? Is doing it myself a wise decision since I don't even have the money to pay my Attorney? Besides copies of application and my previous (now) EAD card, back and front, Do I need to send any other forms with the application i.e I-94? Any help would be appreciated, I am stressing out and with my VAWA still UNTOUCHED I feel lost. Please help.

If you have a pending 485, you can file for the EAD (renewal) for free, as long as the 485 was filed after July 30, 2007.

You will need the I-797C NOA from the 485 to go along with the application for renewal.

You would follow the instructions for the I-765 for what you need to send in addition to the above.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

yup - a renewal whilst a pending I-485 is free. You'll need to include 'fee waiver statement' in a cover letter, included with the renewal application..

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
